국문 초록

  법적 관점에서 보면, 항행수역은 내수를 포함한 연안국의 배타적 관할권이 적용되는 영해, 접속수역, 국제항해에 사용되는 해협, 배타적 경제수역 및 연안국이든 내륙국이든 모든 국가에 개방되어 있는 공해로 구분할 수 있다. 모든 국가의 선박은 영해, 국제해협 및 군도구역에서 방해받지 않는 무해통항 또는 통과통항의 권리를 향유한다. 그러나 연안국은 항해안전에 관하여 필요한 경우, 무해통항 또는 통과통항에 관한 자국의 법률이나 규정을 채택할 수 있고, 통항로 또는 해상교통분리제도를 사용하여 통항권을 행사하는 외국선박에 선박통항규정을 준수하도록 요구할 수 있다. 도한 무해 도는 통과 통항중인 선박은 일반적인 국제해상충돌방지슈칙과 연안국이 채택한 해상교통법을 준수하여야 한다. 다라서 이 논문은 각 항행수역에 있어서 선박의 통항권과 해상교통법의 적용에 관하여 연구하고자 한다.

영문 초록

  In the view of legal points, The navigation waters may be classified as territorial waters including internal waters appling the exclusive jurisdiction of the coastal State, contiguous zone, straits used for international navigation, exclusive economic zone and high seas which are open to all states, whether coastal or landlocked. Ships of all States enjoy the right of innocent passage or transit passage which shall not be impeded through the territorial sea, in the straits and in the archipelagic waters.
  But the coastal State may adopt laws and regulations relating to innocent or transit passage, where necessary having regard to the safety of navigation, require foreign ships exercising the right of passage to use such sea lanes and traffic separation schemes as it may designate for the regulation of the passage of ships. Ships in innocent or transit passage shall comply with generally International Regulations for Preventing Collisions at Sea and the rule of the road at sea which is adopted by the coastal State.
  Therefore, this paper aims to discuss the right of passage for vessel and application of the rule of the road at sea in each navigation waters.
