국문 초록

  이 글은 2006년 해사노동협약의 핵심 쟁점이 되었던 적용범위를 연구하고 우리 선원법에 이를 수용하기 위한 방향을 제시하는 것을 목적으로 한다. 이 연구는 물적 적용범위와 관련하여 선박의 정의와 항행구역, 인적 적용범위와 관련하여서는 선원의 정의 및 선박소유자의 정의를 구체적으로 해석하고 우리 선원법과 비교 분석하여 그 차이점을 도출하였다. 연구 결과로서 첫째, 동 협약을 우리 선원법에 수용하기 위해서 동 협약을 전적으로 적용하여야 할 선박(항해선)과 적용을 배제하거나 완화할 수 있는 선박(비 항해선)으로 구분하도록 우리 선원법의 적용범위 규정을 개정하고, 둘째, 어떠한 직무로든 선내에 고용되거나 종사하거나 근로를 하는 자를 모두 선원으로 정의하되 대통령령으로 정하는 자에 대해서는 노사와 협의 후 적용을 제외할 수 있도록 선원법을 개정하며. 셋째, 선박소유자의 개념을 명확히 하고 동 협약을 충족하도록 선박소유자에 대한 기능적 요건을 개정하며 선박소유자의 정의를 신설하는 방향으로 선원법을 정비할 필요가 있다는 것을 제시하였다.

영문 초록

  This paper intends to study the scope of application which was one of the key issues of the Maritime Labour Convention 2006 and propose the directions for implementing it in the Seafarers" Act. This study interprets in detail the definition of ship and trading area in relation to the physical scope of application and the definitions of seafarer and shipowner in relation to human scope of application and presented the differences through making comparative analysis with the Seafarers" Act. The results of this study proposes that firstly the scope of application of the Seafarers" Act needs to be amended to differentiate the ships(seagoing ships) to which the Convention shall be fully applicable and the ships(non-seagoing ships) to which the Convention shall not be applied or be relaxed, secondly Seafarers" Act needs to be amended to accommodate that a seafarers shall be defined as any person who is employed, engaged or works in any capacity on board except as expressly provided otherwise in the Presidential Decree after consultation with the relevant social partners, thirdly the concept of shipowner needs to be clarified and the functional requirements for shipowner needs to be revised and the definition of shipowner needs to be newly enacted in the Seafarers" Act in order to be in compliance with the Convention.
