국문 초록

  선박의 국적은 어떤 국가가 선박에 대하여 관할권을 가지며 또한 행사하는지, 어떤 국가가 선박의 작위 혹은 부작위로 인한 국제법상 책임을 지는지, 혹은 어떤 국가가 선박을 위한 외교적 보호권을 가지는지에 대하여 보여줌으로써 바다의 질서를 유지시킨다. 그러나 현재 국가들이 그들의 국적을 선박에게 부여함에 대한 관행이나 절차를 달리하고 있다.
  더구나 원칙적으로 선박은 선박의 국적 국에 종속된다. 그리고 국가들이 그들의 국적을 가진 선박에 대하여 선박의 안전에 관한 국제협약 준수를 효과적으로 관할하지 못하거나 조종하지 못한다면, 이는 여러 문제를 일으킬 것이다. 이러한 관점에서 본고는 현재 선박의 국적 부여에 관한 관행 및 절차에 대하여 살펴보고, 이러한 관행이나 절차가 보다 안전한 선박 및 보다 깨끗한 바다를 이루려는 국제 사회의 목표에 어떠한 영향을 미치는지 살펴보고자한다.

영문 초록

  The principal reason why ships have a nationality is to maintain order at sea because ships" nationality shows that which state is having or exercising the jurisdiction over the vessel, that which state is responsible in international law for a ship in relation to an act or omission of the vessel that is attributable to the state, and that which state is entitled to exercise diplomatic protection on behalf of a ship. But current practices and procedures granting their nationality to ships in international community are different and various.
  In addition, ships are only bound by their national states in principle. And if a state exercises ineffective jurisdiction or control over the vessels, which have their nationality, to ensure compliance of their vessels with the safety related conventions, it would generate many problems. From a this point of view this paper examines current practices and procedures for ships" nationality and its consequences in relation to safer ships and cleaner seas.
