PSI의 법적 정당성 확보에 관한 일고찰

국문 초록

  2002년 12월 9일 북한상선 서산호 억류사건이 있은 후, 2003년 5월 31일 폴란드의 크라쿠프에서 부시 미국 대통령의 제창으로 대량살상무기방지구상 즉 PSI는 출범하였다. 그러나 PSI를 실행함에 있어서 전통국제법 원칙으로 확립되어 있는 영해에서의 무해통항권 및 공해에서의 자유통항권에 대한 침해 가능성은 해결되지 못하였다. 이에 대하여 미국은 「유엔안전보장이사회결의 제1718호」의 채택, 「1988년 SUA 협약」의 개정, 주요 해운국과의 혐의선박 승선？검색 허용에 관한 양자협정 체결 등의 조치를 취하였다. PSI 활동체제는 장래에 있어서도 대량살상무기 적재 혐의선박에 대한 임검권 행사의 법적 정당성을 확보하기 위하여 참여국 확대 노력을 지속할 것으로 전망된다.

영문 초록

  After introduction of the PSI by the US President George W. Bush at the 11 participating states meeting held at Krakow, Poland on 31 May 2003, the international society made efforts to secure the lawfullness of the PSI.
  The UN Security Council adopted 4 Resolutions, which are Resolution 825 in 1993, Resolution 1540 in 2004, Resolution 1695 in 2006, Resolution 1718 in 2006. Especially the Resolution 1718 is based on the Chapter 7 of the UN Charter, and it made up for legal deficiency in interdiction of the WMD shipment.
  The normative force of the PSI system was strengthened more by the amendment of the IMO/SUA Convention as a non-proliferation convention.
  USA concluded a series of bilateral agreements with major flag states, and interdiction could take place on the high seas according to national authorization by the flag states, as it is prescribed in the agreements.
  The text of shipping minute concluded between the South and North Koreas on 28 May 2004 has not direct relevancy with the PSI.
  Notwithstanding the every efforts to secure the lawfullness of the PSI made by the international society, the possibility of invasion of the right of innocent passage in the territorial waters and the right of free navigation on the high seas is not clearly resolved.
