국문 초록

현행「국유재산법」에 따른 공용물인 정부청사 출입자를 대상으로 하는 출입제한 등 처분은 정부청사의 질서유지와 안전확보를 위한 필수적인 조치라고 할 수 있다. 특히 출입제한, 강제퇴거 등과 같은 권력적 사실행위는 출입자인 상대방의 기본권 침해로 귀결될 가능성이 매우 높다. 정부청사라는 공용물 관리를 위해 시행되고 있는 현행 「정부청사관리규정」은 모법(근거법)이 없는 대통령령으로 법률유보원칙과 국내 법령체계의 정합성에 반한다는 문제점이 있다. 정부청사 출입자를 대상으로 하는 출입제한, 강제퇴거 등 조치는 국민의 권리를 제한하고 의무를 부과하는 침익적 행정행위로 이를 법규명령 방식으로 정립된 「정부청사관리규정」은 규범의 집행력 차원에서 분명 한계가 있다. 이러한 점을 고려하여 국유재산인 정부청사를 효율적으로 관리하고 정부청사에 입주한 중앙행정기관, 출입자를 대상으로 법률상 이행력을 확보할 수 있도록 하는 기본원칙, 관리 기준 등을 법률에 명확히 규정할 필요가 있다. 법률에 포함되어야 할 공물관리권의 구체적인 내용은 출입절차 미준수자에 대한 출입제한, 강제퇴거 등을 위한 명확한 법적 근거 마련과 아울러 방호인력의 신체적 유형력 행사와 보안장비 사용 등 직무수행에 필요한 권한 확보를 위한 규정을 신설함으로써 정부청사 보안관리 역량을 보다 강화할 필요가 있다.

영문 초록

The dispositions such as limited access authorization for visitors to government office buildings being property for public use under the current State Property Act may be the necessary measures to ensure maintenance of order and securing of safety. Especially, it is highly likely that powerful real acts such as limited access authorization and compulsory eviction are concluded as violation of basic rights of the other parties being the visitors. The current Government Buildings Management Regulation which is being enforced for managing property for public use such as government buildings is a presidential decree without the parent law (basis law) and has the problem that it is against the principle of statutory reservation and coherence of the domestic legal system. The measures such as limited access authorization and compulsory eviction for visitors to government office buildings are invasive administrative acts restricting the rights of the people and imposing obligations, and the Government Buildings Management Regulation which is established as the means of legal order thereof clearly has the limitation in the level of power of execution of norms. It is necessary to clearly provide for the basic principles, management standards, etc. allowing efficient management of government office buildings being the state property and ensuring legal power of implementation for visitors to the central administrative agencies occupying government office buildings in the laws. The specific contents of the rights to manage property for public use need to include restriction on access and compulsory eviction of persons who have failed to comply with the access procedures. In addition, it is necessary to strengthen the capacity for security management of government office buildings by newly establishing the regulations for securing job authority including, but not limited to, exercising physical force and using security equipment of protective personnel.
