국문 초록

2000년대 이후 안전 문제는 중요한 헌법 문제로 떠 롤랐다. 특히 대형사고로 인하여 다수의 국민이 희생될 때마다, 안전 문제는 국가의 과제로 헌법의 문제였다. 헌법학계는 오래전부터 안전 문제를 국민의 기본권 차원에서 안전권으로 다루었다. 안전권이 하나의 독자적인 기본권이 될 수 있는지 이에 대해서는 여전히 논의가 계속되고 있다. 그런데 안전권의 기본권화에 부정적인 입장에서는 국민의 안전에 관한 것은 국가의 과제 내지 책무에 해당한다고 주장한다. 헌법학계와 마찬가지로 스포츠법학계에서도 10여 년 전부터 스포츠안전에 관한 연구가 시작되었다. 스포츠안전권을 하나의 기본권으로 보자는 시각에서부터 스포츠안전에 관하여 기본권적 시각에서보다는 법제적 시각에서 스포츠안전에 관하여 관련법의 제정을 통하여 접근하는 것이 필요하다고 보는 입장도 있다. 어떤 견해가 스포츠안전을 위하여 적절한지는 법리적으로 판단하기 어렵다. 그러나 스포츠안전이 주로 스포츠시설의 안전과 관련되어 문제가 발생한다는 점에서 스포츠시설의 안전관리가 무엇보다도 중요하다. 그런데 스포츠안전은 단지 스포츠시설의 안전만이 아니라 스포츠안전 그 자체를 의미한다. 스포츠는 대중화･생활화를 통하여 국민의 삶 속에 한 부분이 되었다. 스포츠안전은 스포츠활동을 하는 과정에서 발생하는 모든 안전에 해당하는 문제이다. 스포츠기본권 차원에서 스포츠안전에 관한 권리를 보장하는 것이 중요하지만, 스포츠 관련 법제에서 스포츠안전에 관한 내용을 법제화하는 것이 필요하다. 스포츠안전은 스포츠인의 안전만이 아니라 국민의 안전에 관한 문제라는 점에서 스포츠안전에 관한 법제를 구축해야 한다. 이를 위하여 스포츠안전을 포함하는 스포츠기본법의 제정이 필요하다.

영문 초록

Since the 2000s, safety issues have emerged as important constitutional issues. In particular, whenever a large number of people were sacrificed due to a major accident, the safety issue was a matter of the Constitution as a national task. For a long time, the constitutional academy has dealt with safety issues as a security right in terms of people s basic rights. There is still debate on whether a security right can be an independent basic right. However, in a negative position on the basic right to safety, it is argued that the safety of the people is a national task or responsibility. As with the constitutional academia, research on sports safety began in the sporting academia more than a decade ago. Some believe that it is necessary to approach through the enactment of related laws on sports safety from a legal point of view, rather than from the basic rights point of view, from the point of view of considering the sports safety right as a basic right. It is difficult to judicially determine which views are appropriate for sports safety. However, safety management of sports facilities is the most important because sports safety is mainly related to the safety of sports facilities. However, sports safety means not only the safety of sports facilities, but also sports safety itself. Sports have become a part of the people s lives through popularization and living. Sports safety is a problem that applies to all safety that occurs in the course of sports activities. While it is important to guarantee the rights of sports safety at the basic level of sports, it is necessary to legislate the contents of sports safety in sports-related legislation. Sports safety is not only about the safety of sportsmen, but also about the safety of the people. For this, it is necessary to enact the Basic Sports Act, which includes sports safety.
