국문 초록

본 논문의 목적은 서구철학에서 규정하는 균등분배나 분배의 정의보다는 재산상속에서 유학의 공정성이 무엇인지, 그리고 어떻게 적용되는지를 분석하는 것이다. 재산상속에 적용되는 유학의 공정성과 원리를 밝히는 것은 중요할 뿐만 아니라 오늘날 한국사회에서 그것을 연구하는 것은 의미가 있다. 왜냐하면 재산상속 문제를 법적인 방식으로 해결하기 전에 윤리적·문화적으로 접근하는 것이 반드시 필요하기 때문이다. 그러기 위해 우선, 유교가 혈연, 학연, 그리고 지연이라는 부정적인 요소를 가지고 있다는 비판에도 불구하고, 유학이 공정성을 담보하는 확고한 원리를 가지고 있는지 검토해야 한다. 다음으로, 유교문화가 여전히 존재하는 한국에서 공정성에 대한 유학의 기준이 무엇인지, 그리고 그 공정성 기준이 재산상속에 어떻게 적용되는지 분명히 할 필요가 있다. 재산상속에서 균등분배의 방식이 무조건적으로 공정한 분배기준은 아니다. 이러한 작업을 위해 본 연구는 조선 선비 가문의 ‘분재기’를 분석하고, 그 안에서 공정한 분배가 무엇인지 확인한다.

영문 초록

The purpose of this paper is to clarify what Confucian fairness and how it applies to inheritance of property, rather than ‘the justice of distribution’ in equal distribution or Western philosophy. It is also important to identify the fairness of Confucianism and the principles it applies to property inheritance, but it will also be meaningful to study it in Korean society today. Because it is necessary to approach the problem of inheritance from an ethical and cultural point of view before it can be solved by a legal method. First, despite the criticism that Confucianism has negative factors such as blood ties, school ties, and regional relations, it should be examined whether it holds firmly the principle of guaranteeing fairness. Next, it is necessary to clarify what the Confucian standard of fairness is in Korea, where the Confucian culture still exists, and how the standard of fairness applies to property inheritance. Unconditionally, the method of equal distribution in property inheritance is not a fair distribution standard. For this work, this study analyzes the ‘Bunjaegi(分財記, property distribution record)’ of Seonbi family in the Joseon Dynasty, and idenfifies what is a fair distribution within it.
