기초생활보장 수급자의 의사결정지원 유형분석과 평가

국문 초록

이 연구는 사회복지에서 가장 취약한 대상을 고객으로 하는 기초생활수급제도의 급여관리제도가 의사결정 지원 관점에서 얼마나 수급자의 최선의 이익을 위한 방향으로 정비되어 있는지 분석한다. 또한 최선의 이익을 위한 의사결정지원의 유형과 논리를 이론적으로 분석한다. 의사결정의 지원은 전문가나 공무원 등이 본인에게 가장 이익이 되는 방향으로 대신 결정하고 관리하는 형태(대리적 의사결정)가 아니라, 스스로에게 가장 최선의 이익이 되는 선택을 할 수 있도록 본인의 자율성을 최대한 지원하는 의사결정이 기본방향이 되어야 한다. 의사결정지원은 본인의 가치나 의향 등에 대한 대변자로서의 역할을 하면서 본인의 중심의 의사결정을 이끌어내야 한다. 판단능력이 불충분한 수급자의 의향과 감정 등을 보다 구체적으로 이해하기 위해서는 의사결정지원제도가 필수적이다. 이러한 의사결정지원은 본인의 자율을 지원하는 방향이 되어야 하며, 자율적 의사결정은 독립적 의사결정만이 아니라 판단능력이 불충분한 사람이 타인의 도움을 받아서 본인의 최선의 이익을 위한 대안을 결정하는 지원적 의사결정을 의미한다. 기초생활보장제도는 판단능력이 불충분한 사람에 대한 급여관리 제도를 도입하고 있다. 의사결정지원 유형은 대리적 유형과 지원적 유형이 있는데, 기초생활수급제도의 경우 유형, 목표, 판단기준, 역할을 기준으로 분석한 결과, 행정기관이나 가족이 결정을 전적으로 대신하는 대리결정 유형이다. 기초생활보장제도의 수급비 관리와 관련하여 의사결정 지원체제 유형은 본인 중심의 지원적 역할에 충실한 대응태세는 전무하며 그에 대한 문제의식도 없다고 평가할 수 있다. 급여 관리의 목적과 원칙, 급여 관리 범위, 급여 관리자 지정 및 점검과 관련된 매뉴얼 상에도 행정기관의 관리자 범위 설정과 지정 등에 대한 대리적 결정 지침과 방향만 볼 수 있다. 하지만 판단능력이 불충분한 사람이라도 본인의 잔존능력의 활용과 인권을 기반으로 생각한다면, 주관적 의향의 판단에 도움이 되는 조력을 받아 결정하는 지원적결정이 권장되어야 한다. 이러한 체제는 사회적 약자의 자율성을 존중하는 사회로서 행정기관을 비롯한 공적 복지기관은 부모와 같은 역할이 아니라 본인의 권능을 발휘하도록 지원하는 조력 역할을 수행해야 한다. 의사지원자의 서비스를 활용하여 본인의 역량을 극대화하고 최선의 이익을 추구할 수 있도록 지원이 이루어져야 한다.

영문 초록

The purpose of this research is to analyze whether the system to manage salaries of beneficiaries is being developed in the direction for their own interests. I analyzed the type of decision support for the best interests. There are two types of support for decision making. First, experts and civil servants make decisions, not in the direction to get the most benefit to people. Secondly, it is a type that supports themselves to make the most profitable choices for themselves. Decision support should play a role as a spokesman for his or her own values and intentions. And should bring down the decision of the principal s center. Decision support must be in a direction to support autonomy, and a person with weak judgment ability makes a decision through help. Korean public assistance has introduced a payroll system for those with insufficient judgment ability. We analyzed Korean public aid based on type, goal, judgment criteria and role. As a result, South Korea is the type of proxy decision in which administrative agencies and families completely replace decisions. In connection with payroll management, evaluation of decision support type is not faithful to the role of support person-centered support, and there is no problem consciousness to it. The purpose and principle of payroll accounting, the scope of payroll management, the manual related to the designation and confirmation of payroll administrators can also know only the guidelines and directions of proxy decisions of the administrative ranges of administrative organizations. However, even those with insufficient judgment skills should recommend the idea of choosing with the help of subjective choice, if it is based on the utilization of the residual abilities of the principal and human rights. These systems aim at a society that respects the autonomy of socially vulnerable people. Public welfare organizations such as administrative agencies need to perform roles to assist them not to play like parents but to support themselves. We must utilize the services of doctor applicants to maximize the individual s ability and support the best interests.
