재난민복지법의 제정 방향에 관한 연구

국문 초록

사회복지의 관점에서 재해구호법의 문제점은 사회복지의 이념․가치․기본원칙의 부재 및 실시주체의 책임 불명확, 적용범위의 협소 및 수급권자의 불명확, 전문적인 심리사회서비스의 부족, 전달체계의 통합성․연계성 부족, 국가와 지방자치단체의 공적 비용부담의 부족 등으로 파악되었다. 이들 문제점을 해결하기 위한 재난민복지법의 주요 제정 방향은 다음과 같이 나타났다. 첫째, 재난민복지법의 총칙에 사회복지의 이념․가치 및 기본원칙을 적용하고 국가와 지방자치단체의 책임을 명시적으로 규정하여야 한다. 둘째, 재난민복지법의 적용범위를 확대하고 수급권자를 1종과 2종으로 분류하여 지원서비스의 내용과 기준을 달리 정하도록 해야 한다. 셋째, 재난민을 위한 사회․심리․복지서비스 및 정신보건서비스, 재난지역의 공동체성 회복서비스 그리고 재난약자들을 위한 특수 서비스 등 전문적인 서비스가 중․장기적으로 제공될 수 있도록 명문화하여야 한다. 넷째, 재난민을 위한 서비스의 전달체계에 민간사회복지관련 기관․조직들을 반드시 포함시켜 통합성, 연계성을 강화하고 전문인력의 양성체계를 명확히 규정하여야 한다. 다섯째, 국가와 지방자치단체의 공적 비용부담 책임을 강화하고 민간부문의 재원 부담은 보완적이 되도록 법제화하여야 한다.

영문 초록

From the viewpoint of social welfare, problems of Disaster Relief Act are the lack of ideology, values, basic principles of social welfare, unclearness of the implementing bodies’ responsibility, unclarify of the scope of applicability and the eligible recipient, shortage of professional service, lack of delivery system’s integrity and connectivity, incompletion of the state and local governments’ burden of public costs etc. To solve these problems, legislating direction of the Welfare Act for the Sufferers from Disaster is as follows: First of all, ideology, values, basic principles of social welfare should be applied in the general provisions. It is also necessary to regulate clearly responsibility of the state and local governments in the general provisions. Second, the scope of application need to clearly define and eligible recipient should be set differently by classifying as type1 and type2. Third, It is necessary to stipulate that professional services such as social, psychological, welfare services and mental health services for sufferers from disaster, recover of collectivity in disaster areas, and special services for vulnerable persons to disaster should be provided for long period. Fourth, private social welfare agencies and organizations must be included in the service delivery system, and clearly define the skilled manpower training system to strengthen integration and connectivity. Fifth, it should tighten the cost burden of the state and local governments and legislate to make the financial burden of the private sector complementary.
