국문 초록

본 연구는 소년범죄에 대한 재범방지와 예방을 위해 우리나라 청소년범죄의 실태와 현행 청소년 보호처분 현황에 대한 이해와 더불어 한계점을 알아보고 재범방지를 위한 교정복지적 실천방안으로서의 ‘회복적 사법정의(Restorative Justice)’를 제시하였다. 소년범죄에 대한 실태를 파악하고 현행 소년사법에 대한 이해를 거쳐야 소년범죄에 대한 재범방지와 예방에 도움이 될것이다. 갈수록 저연령화, 흉포화, 지능화되고, 재범율이 증가하며 쉽게 성인범죄로 이어지는 소년범죄에 대한 예방과 재범방지를 위한 교정복지적 실천방안이 시급하다. 소년범죄의 원인은 다양하고 복잡하며 범죄와 관련된 대상의 특성도 다양하다. 가해자, 피해자, 가해자 가족, 피해자 가족, 집단, 지역사회, 국가에 이르기까지 한 범죄로 인한 영향은 막대하다. 이렇게 수많은 범죄 요인들에 대한 개입을 단순히 사법체계의 잣대에만 의존하여 해결한다면 수많은 범죄관련 당사자들에게 미칠 악영향으로 더 무서운 결과를 초래할 것이다. 더욱이 우리사회는 구성원의 다양성을 인정하기에 그에 따른 다차원적인 범죄원인에 맞서기 위해서 적절한 대책과 실천방법이 요구된다. 특히 청소년기의 특성에 대한 기본적인 이해가 있다면 소년보호처분에만 의존하기보다는 교정복지적인 접근이 더 효과적임을 알 수 있다. 이를 위한 대안으로 회복적 사법정의에 대해 알아보았다. 소년사법체계의 발전방향과 효과적인 정책의 실천을 위해 회복적 사법정의를 우리나라 실정에 맞게 적용할 수 있도록 연구하고 개발하는 적극적인 실천과 노력이 요구된다.

영문 초록

This study is to find out and understand the limitations of the current situation of juvenile delinquency and the juvenile protective disposition for exploring prevention measures for juvenile delinquency and its repetition. Then we present Restorative Justice perspectives that give a meaningful implications for correctional work practice in the future. In our society, statistics show increasing atrocities, lowering the crime age and intelligent crimes, therefore correctional welfare practice for the crime prevention and decreasing recidivism should be recognized enough as an urgent social problem. There are various causes of juvenile delinquency and complex characteristics of the target associated with crimes. Impacts on the crime victims, their family, the community even the offenders themselves is rapidly spread and very strong. The existing intervention for criminal problems by the current justice system does not work properly to remove such a negative and painful effects caused by the crimes. Furthermore, our society requires the proper measures and practices in order to remove the multi-dimensional crime causes related to human diversity in the multi-cultural society. Especially if we have better understanding of the characteristics of adolescence, it can be found that a more effective approach and correctional welfare, rather than relying only youth protection disposal. As results, we suggest the Restorative Justice is an alternative and potentially powerful approach for making the system effective. Restorative Justice is considered as a new avenue for the treating criminal issues and correctional field in the level of government and private practice, so that active efforts based on Restorative Justice with making endeavors to adapt to the our situation is required for the implementation of proper policies and measures in the juvenile justice system.
