샌프란시스코 강화조약의 한국 현대사적 의미 - 영토 조항을 중심으로

국문 초록

‘한일기본조약’은 샌프란시스코 강화조약에 따른 서브 시스템이므로, 이러한 관점에서 샌프란시스코 강화조약의 영토조항이 지닌 의미를 다시 한번 되새겨 볼 필요가 있다. 이는 샌프란시스코 강화조약 및 ‘한일기본조약’에서 다루어지지 않았던 식민지 청산 문제와도 밀접하게 관련된 내용이기도 하다. 따라서 이 논문에서는 샌프란시스코 강화조약의 영토조항과 그 서브 시스템인 ‘한일기본조약’ 체결 과정에서 독도문제가 어떻게 다루어졌는지에 대한 현재적 재검토를 통해 독도문제를 한국의 현대사적 의미에서 분석한 것이다. 그 과정에서 국민국가의 중요한 요소 중 하나인 영토문제, 즉 독도문제는 한국 현대사의 질곡 속에서 떠돌기만 했을 뿐, 중심 과제로 등극하지는 못했다는 것을 알 수 있었다. 그 결과 지금에 와서는 한일 양국에서 모두 내정화되어 정치적 도구로 전락하고 말았다. 샌프란시스코 강화조약의 영토조항은 이런 결과를 초래한 근본적인 원인이기도 하다. 한일 간의 과거사 청산은 식민지배에 대한 명확한 사죄와 재발 방지를 위한 노력의 터전 위에 이루어져야 한다. 독도문제 또한 같은 맥락에서 해결되어야 하는 역사적 문제이다. 샌프란시스코 강화조약은 이에 대한 고려가 부족했으며, 반공 이데올로기를 바탕으로 작성된 매우 부실한 조약이었다. 그리고 ‘한일기본조약’ 또한 반공 이데올로기와 결합되어 맺어진 조약이었으므로 태생적인 한계가 있었다. 따라서 이를 해결하기 위해 반 식민주의를 제창한 2001년 8월을 '더반 선언'을 실마리로 삼을 것을 제안한다

영문 초록

Since the 'The Treaty on Basic Relations Between Japan and the Republic of Korea' is a sub-system under the San Francisco Peace Treaty, it is necessary to reconsider the significance of the San Francisco Peace Treaty's territorial provisions from this point of view. This is also closely related to the issue of colonial liquidation that was not addressed in the San Francisco Peace Treaty and the 'The Treaty on Basic Relations Between Japan and the Republic of Korea'. Therefore, this paper analyzes the Dokdo issue in the sense of modern Korean history through a present review of the territorial provisions of the San Francisco Peace Treaty and how the Dokdo issue was dealt with in the process of signing the 'The Treaty on Basic Relations Between Japan and the Republic of Korea', a sub-system of the San Francisco Peace Treaty. In the process, it was found that the territorial issue, or Dokdo issue, which is one of the important elements of the nation-state, only floated in the throes of modern Korean history and did not emerge as a central task. As a result, it has now been internalized and reduced to a political tool in both Korea and Japan. The territorial provisions of the San Francisco Peace Treaty are also the root cause of this result. The settlement of history between Korea and Japan should be based on a clear apology for colonialism and efforts to prevent recurrence. Dokdo is also a historical issue that must be resolved in the same context. The San Francisco Peace Treaty was a very poor treaty based on an anti-communist ideology and lacked consideration. And because the 'The Treaty on Basic Relations Between Japan and the Republic of Korea' was also a treaty formed in conjunction with an anti-communist ideology, there were inherent limitations. Therefore, to solve this problem, it is suggested that the 'Durban Declaration', which advocated anti-colonialism, should be used as a clue in August 2001.
