국문 초록

본 연구는 2027년 1월부터 적용되는 광역 저상버스 도입 의무의 원활한 이행과 제도적 기반 제공을 위해 교통약자 이동편의 증진을 위한 휠체어 탑승 광역 저상버스 법·제도 현황 및 개선 방안에 목적을 두고 있다. 이를 위해 휠체어 탑승 광역 저상버스와 관련된 법·제도 체계와 제기된 논란의 법·제도 차원 검토 등을 연구 범위로 설정하여 수행된 질적 연구이다. 연구는 거시적 차원에서 교통약자 이동편의 증진을 위한 법·제도 체계를 ‘인적 차원’과 ‘물적 차원’으로 구분하여 현황을 파악하고, 미시적 차원에서 휠체어 탑승 저상버스에 제기된 논란에 대하여 법·제도 차원에서 검토하였다. 그 결과, 장애인 이외의 교통약자 권리구제 근거 마련, 휠체어 탑승 저상버스 도입·운행 실효성 제고를 위한 점검·유지·관리 의무 조항, 저상버스 예외 승인의 절차적 공정성과 투명성 확보, 교통약자 이동편의 증진 법·제도 체계의 법리 명확화와 일관성 유지 등 교통약자 측면에서 개선해야 할 법률과 규칙 개정안 4개를 도출하였다. 최종적으로는 도출된 개선안의 법률 개정추진 등 5개의 정책적 제언을 제시하였다. 본 연구는 휠체어 탑승 친환경 광역 저상버스의 원활한 도입을 위한 생활밀착형 법·제도 연구로서의 의의가 있다. 또한, 인적 차원의 법·제도 체계뿐 아니라, 기술적 요인을 포함한 물적 차원의 법·제도 체계연구로 범위를 확대하여 기존 연구와의 차별성을 가진다.

영문 초록

This study aims to review the current status of laws and systems on wheelchair ride-on conurbation low-floor buses for convenience-enhancing of mobility handicapped in Korea, and measures to improve them to smoothly implement conurbation low-floor buses that will be mandatory from January 2027 and provide an institutional foundation. To this end, this qualitative study is conducted with the scope set to review the laws and systems related to wheelchair ride-on conurbation low-floor buses which have raised controversies. At the macro level, the study divided the laws and systems for improving the convenience of transportation for the mobility handicapped into the ‘human dimension’ and ‘material dimension’ to understand the current status, and at the micro level, reviewed the controversies raised on wheelchair ride-on low-floor buses at the laws and systems level. As a result, four amendments to laws and systems that need to be improved from the perspective of the mobility handicapped were derived, such as establishing a basis for relief for the rights of mobility handicapped people other than the disabled, mandatory provisions on maintenance and inspections for wheelchair ride-on low-floor buses, securing procedural fairness and transparency in the approval of exceptions to low-floor buses, and maintaining consistency and clarity of legal principles for the mobility handicapped. Finally, five policy suggestions were presented, including legal revisions for the amendments to laws and systems derived. This study is significant as a study on laws and systems closely related to life for the smooth introduction of wheelchair ride-on eco-friendly conurbation low-floor buses. In addition, it is different from existing studies by expanding the scope of laws and systems on the material dimension, including technical factors.
