다문화 가정 장애아동 특수교육 지원을 위한 국제협약 기준과 국내법 고찰

국문 초록

연구목적 본 연구는 국제협약 기준과 국내법을 검토함으로써 다문화 가정 장애아동을 위한 특수교육 지원 방안에 대해 논의하는 것을 목적으로 하였다. 연구방법 이를 위하여 국제협약 기준은 ‘아동 권리협약’, ‘장애인 권리협약’, ‘모든 이주 노동자와 그 가족의 권리 보호 국제협약’, 국내법은 ‘다문화 가족 지원법’, ‘재한외국인처우기본법’, ‘초·중등교육법’, ‘장애인 등에 대한 특수교육법’, ‘청소년복지 지원법’, ‘장애아동복지 지원법’, ‘장애인복지법’ 등 관련 문헌과 법적 기준을 검토하였다. 연구결과 연구 결과는 다음과 같다. 첫째, 국제협약에서는 다문화 가정 장애아동을 포함한 모든 아동을 차별하지 않고 적절한 교육을 제공해야 한다는 것을 강조한다. 둘째, 국내법에서는 다문화 가정 장애아동에 대한 진단및 지원 체계 부족으로 장애(위험) 아동의 조기 발견과 개입에 제한이 있었으며, 다문화 가정의 체류 자격과 자녀의 장애 등록 여부에 따라 지원이 제한되었다. 국내법에서는 다문화 가정 장애아동에 대한 진단 및 지원 체계의 부족, 장애(위험) 아동의 조기 발견과 개입의 제한, 다문화 가정의 체류 자격과 자녀의 장애 등록 여부에 따른지원에 제한이 있는 것으로 나타났다. 셋째, 다문화 가정 장애아동의 특수교육 지원을 위한 법적 정의 확대, 조기 진단과 개입의 강화, 다국어 진단 도구 개발, 특수교육과 복지·보건의 연계 강화 등 법적·제도적 개선이 필요한 것으로 확인되었다. 결론 본 연구는 다문화 가정 장애아동을 포함한 모든 아동이 동등한 교육 기회를 누릴 수 있는 포용적 사회로의발전에 기여할 것으로 기대한다.

영문 초록

Purpose The purpose of this study was to discuss special education support for children with disabilities in multicultural families by reviewing international convention standards and domestic laws. Method For this purpose, relevant literature and legal standards were reviewed, including the Convention on the Rights of the Child, the Convention on the Rights of Persons with Disabilities, and the International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families, as well as the Multicultural Family Support Act, the Act on the Treatment of Foreigners in Korea, the Elementary and Secondary Education Act, the Special Education Act for Persons with Disabilities, the Youth Welfare Support Act, the Welfare Support Act for Children with Disabilities, and the Disability Welfare Act. Results The findings of the study are as follows. First, international conventions emphasized that all children, including children with disabilities in multicultural families, should be provided with an appropriate education without discrimination. Second, domestic laws showed a lack of diagnostic and support systems for children with disabilities in multicultural families, limited early identification and intervention for children with disabilities (at risk), and restrictions on support based on the immigration status of multicultural families and whether or not the child is registered with a disability. Third, legal and institutional improvements were identified as necessary, including expanding the legal definition of special education support for children with disabilities from multicultural families, strengthening early diagnosis and intervention, developing multilingual diagnostic tools, and strengthening the link between special education, welfare and health. Conclusion This study would contribute to the development of an inclusive society where all children, including children with disabilities from multicultural families, have equal access to education.
