인신매매 피해자 식별지표의 활용과 개선방안에 대한 논의

국문 초록

2023년 1월 1일부터「인신매매등방지 및 피해자보호 등에 관한 법률」이 시행되면서 인신매매의 개념을 확장하여 노동착취, 성적착취 및 성매매등 피해자를 보호·지원할 수 있게 되었다. 법률에서는 인신매매등 범죄를 탐지하여 잠재적 피해자를 식별하기 위해 인신매매 교육과 함께 인신매매 식별지표의 사용을 권고하는 내용이 담겼다. 이에 이 연구에서는 법률 시행이 1년이 지나가는 시점에서 인신매매 식별지표에 대한 검토와 효과적 활용을 위한 개선방안을 논의하고자 하였다. 이를 위해 법률상 식별지표 활용권고기관인 경찰청, 검찰청, 고용노동부, 해양수산부 종사자 150명을 대상으로 설문조사를 수행하였다. 설문조사는 인신매매 발생현황에 대한 오해 및 관련 법률에 대한 인지여부, 식별지표에 대한 생각에 대한 내용으로 구성된다. 연구결과를 분석하여 개선방안으로 식별교육의 의무화 및 대상의 확대, 신고 및 식별지표의 디지털화, 대상별 식별지표의 세분화 및 기타 제도의 정비 필요성에 대해 논하였다.

영문 초록

Since January 1, 2023, the “Act on the Prevention of Human Trafficking and Protection of Victims” has expanded the concept of human trafficking to protect and support victims such as labor exploitation, sexual exploitation, and prostitution. The law recommends the use of human trafficking identification indicators along with human trafficking education to detect crimes such as human trafficking and identify potential victims. Therefore, this study attempted to review human trafficking identification indicators and discuss improvement measures for effective use at the time when the law was enforced a year later. To this end, a survey was conducted on 150 employees of the National Police Agency, the Prosecutor's Office, the Ministry of Employment and Labor, and the Ministry of Oceans and Fisheries, which recommended the use of legal identification indicators, and the contents of the collected data were classified and analyzed. Through the study, the necessity of mandatory identification education and expanding the target, digitizing reporting and identification indicators, subdividing identification indicators for each target, and reorganizing other systems was discussed.
