국문 초록

전 세계적으로 새로운 유형의 신종마약류(New Psychoactive Substances: NPS)가 유행처럼 빠르게 확산되고 있으며 유통방식도 날로 진화함에 따라 마약류 범죄사건은 그 어느 때보다 가파른 증가세를 보이고 있다. 최근 마약류 문제가 점점 심각해지면서 기존의 마약 관련 기관들의 기능과 역할로는 감당하기 어려운 현실이 되었다. 대부분의 국가들은 마약 없는 사회를 구현하기 위해 공급을 통제·억제하는 형사사법적 처벌모델과 중독자를 재활하는 의료/치료모델을 병용하고 있다. 다시 말해, 큰 틀에서공급통제정책은 주로 철저한 단속과 강력한 처벌에 의존하고 수요억제정책은 치료와 재활 등을 통해 사전적 예방 초점을 두어균형적인 전략을 추구한다. 하지만 대부분의 마약 정책을 펼쳤던 국가들은 불균형적인 정책으로 많은 부작용을 겪었고 이를 해결하기 위해 균형적인 정책집행을 위해 많은 노력을 기하고 있다. 하지만 그 성과에 있어서 국가별 정부의 노력과 예산에 따라천차만별이며, 마약을 관리하는 조직의 구조 또한 다양하다. 이 연구는 우리나라의 마약 관련 기관들의 현황을 파악하고 미국의마약류 통합관리시스템을 전반적으로 검토한다. 주로 미국의 마약단속청(Drug Enforcement Administration, DEA)의 등장배경과 역사적으로 변화해 온 마약정책과 그에 따른 문제점들을 통해 우리나라의 마약정책의 나아가야 할 방향을 논의해본다. 우리보다 먼저 경험하고 발전시켜 온 미국의 종합적인 마약류 정책들의 장단점들을 통해 마약으로부터 건강한 사회를 만들 수 있는구체적이고 실용적인 균형 잡힌 마약 정책을 마련하는데 그 의의가 있다. 즉, 이 연구의 결과를 통해 효율적으로 마약을 대처하는 실용적인 국가시스템을 구축하고 나아가 국민을 마약으로부터 보호하고자 한다.

영문 초록

New Psychoactive Substances (NPS) are spreading like a trend around the world, and the number of drug crimes is increasing more than ever as distribution methods evolve day by day. Recently, as the drug problem has become increasingly serious, it has become an unbearable reality with the functions and roles of existing drug-related institutions. Most countries use a combination of criminal justice punishment models that control and deter drug supply to make the drug-free society and medical & treatment models that rehabilitate addicts. In other words, supply control policies rely mainly on thorough crackdowns and strong punishment, and demand control policies pursue balanced strategies by focusing on prevention in advance through treatment and rehabilitation. However, countries that have implemented most drug policies have experienced many side effects from unbalanced policies and are making great efforts to make balanced policies to solve them. However, the results vary widely depending on the efforts and budgets of each government, also the structure of the organization that manages drugs is diverse. Current study will examine the current status of Korean drug-related institutions and review the U.S. drug integration management system(IMS). And mainly discuss the direction of Korea's drug policy through the background and historical changes of the Drug Enforcement Administration (DEA). It is meaningful in preparing a specific and practical balanced drug policy that can create a drug-free society through the advantages and disadvantages of the U.S. drug IMS . At the conclusion this study establishes a practical national system to efficiently deal with drugs and in turn protect citizen from drugs.
