압수된 불법촬영물의 처리에 대한 고찰 - 일본 최고재판소 결정 및 성적자태촬영등처벌법을 중심으로 -

국문 초록

카메라등이용촬영죄 등과 관련하여 불법촬영물이 양산되고 있다. 수사 과정에서 압 수된 불법촬영물의 경우 몰수가 선고되지 아니하는 이상 피압수자에게 이를 환부해야 하는 상황이 발생하게 된다. 그런데 불법촬영물은 그것이 유포될 경우 촬영대상자에게 회복할 수 없는 손해를 입힐 수 있다. 결국, 형사소송법상 필요적 환부의무와 피해자 보호 사이에 갈등상황이 벌어지게 된다. 최근 일본 최고재판소는 권리남용이론을 들어 위와 같은 갈등상황을 해결하고 있 다. 즉, 불법촬영물이 유포될 경우 생길 수 있는 피해자의 불이익과, 환부를 받지 못함 에 따라 발생하는 피압수자의 불이익을 고려할 때 피압수자가 위 영상에 대한 환부를 청구하는 것은 권리의 남용으로 허용될 수 없다는 것이다. 다른 한편, 일본 의회는 최 근 검찰관이 보관하고 있는 압수물로서 성적자태 등이 기록된 영상물에 관한 소거조 치 등을 할 수 있도록 하는 별도의 법률을 마련하기도 했다. 이에 이 글에서는 일본 최고재판소의 결정, 그리고 일본 의회가 통과시킨 최근의 입 법을 살펴본다. 이를 토대로 불법촬영물에 관한 형사소송법상 필요적 환부의무와 피해 자 보호 사이의 갈등상황을 합리적으로 해결할 수 있는 개선방안을 모색하고자 한다.

영문 초록

A number of illegal filmed materials are mass-produced in our societ y in connection with crimes such as taking photographs or videos by us ing cameras. During the investigation, such illegal filmed materials will be seized, but unless the confiscation is sentenced, they shall be reture nd to the person who has been seized. However, since illegal filmed vi deo can cause irreparable damage to the person shot if it is distributed, so a serious conflict arises between the necessary obligation of return of seized articles and the protection of victims. Recently, the Supreme Court of Japan is resolving the issue above by citing the theory of abuse of rights. In other words, considering the dis advantages of the victim that can occur when illegal filmed materials ar e distributed and the loss of the person who has been seized that arise from not receiving the return, it cannot be allowed for the person who has been seized to claim the return of seized articles as an abuse of ri ghts. Furthermore, the Japanese Parliament recently established the spe cial law with the main content of erasure measures for illegal filmed materials. This article examines the decision of the Japanese Supreme Court an d the recent legislation passed by the Japanese Parliament. Based on th is, I intend to seek solution to resolve the conflict between the necess ary obligation to return and the protection of the person who was shot.
