조사자증언의 증거능력 판단에 대한 실무적 운영 방안

국문 초록

적법절차를 통한 실체적 진실발견이라는 형사소송법의 목적을 달성하기 위하여는 법관이 공판정에서 적법하게 얻어진 다양한 증거방법들을 조사하여 이로부터 얻은 풍 부한 증거자료들을 상호 비교하고 음미하면서 심증을 형성하도록 하는 것이 필요하고, 이를 위하여는 수사 단계에서 확보된 진술이 공판 과정에 현출되는 것은 중요하고 필 요하다. 이러한 필요성에 비추어 수사 단계에서 작성된 모든 피의자신문조서가 피고인 의 내용 부인으로 증거능력이 없어지게 된 현 시점에서 수사 단계에서의 진술을 공판 에서 현출할 수 있는 방안으로 조사자증언제도를 중심으로 그 문제점과 그에 대한 실 무적 운영방안을 살펴보았다. 조사자증언의 증거능력 요건인 특신상태를 판단함에 있어서 진술의 구체성이나 일 관성 등 증명력의 자료를 판단기준으로 삼을 것이 아니라 조사시간이나 장소, 횟수, 조 사참여자, 변호인 동석 여부, 조사 분위기, 당시 피의자의 상태, 영상녹화 여부 등을 종 합하여 판단하여야 하고, 증거조사절차에 있어서도 조사자에 대한 증인신문 후 특신상 태 유무를 판단하는데 부족함이 있다면 특신상태 입증을 위한 별도의 입증활동이 필 요하다. 그 외에도 실무적 운영방안으로서 특신상태를 인정받기 위한 수사기관의 조사 방안, 조사자의 기억의 한계에 대한 문제점에 대한 피의자신문조서와 영상녹화물의 활용 및 조사자증언에 대한 사전 준비 등이 있다.

영문 초록

In order to realize the purpose of the Criminal Procedure Law, judges must form a belief by comparing various evidences. To this end, state ments secured in the investigation stage should be made so that they c an be presented in the future trial process. As a solution, the problems and improvement measures of the interrogator’ testimony system were examined. The particularly reliable state of Interrogator’s Testimony should be determined by combining the time, place, number of investigations, parti cipants in the investigation, the presence of lawyers, the atmosphere of the investigation, the condition of the suspect at the time, and whether a video recording is performed. In addition to witness interrogation of the interrogator during the trial process, if necessary, separate verification activities are required to pro ve the particularly reliable state. Other improvement measures include the investigative agency's investigation plan to be recognized the particularly reliable state, the use of written record of interrogation and video recordings for problems with t he interrogator's memory limitations, and the preparation and training of manuals for the interrogator's testimony.
