국문 초록

《深圳经济特区医疗条例》率先中国尝试护士处方权立法，使得护士处方权的实践有了法律上的依据。但护士处方权的真正实施还存在诸多限制和问题，例如护士处方权的权限范围较为狭窄，护士处方权下的医护关系权责不明，护士处方权的配套实施机制尚付阙如。未来应当从三个方面优化护士处方权的立法和实施：合理确定护士处方权的权限范围，明确医生和护士之间的权利义务界分，完善护士处方权的配套实施机制。

영문 초록

The “Shenzhen Special Economic Zone Medical Regulations” has taken the lead in implementing the “nurses’ prescription right” in China, but there are still many regulatory restrictions and problems in the full implementation of nurses’ prescription right in China. The rights and responsibilities of the new doctor-nurse relationship after the prescription right are unclear, and the relevant management institutions and supervision mechanisms are not perfect after the implementation of the nurses’ prescription right legislation. This paper believes that in order to improve the legislation of nurses’ prescription right in the future, it is necessary to reasonably determine the access standards for nurses’ prescription right, clarify the doctor's supervision responsibility for nurses’ prescription right, and improve the supporting guarantee and management mechanism for nurses’ prescription right.
