초기 계몽운동에서 법 관념의 향방

국문 초록

『독립신문』과 독립협회가 주도한 계몽운동과 정치운동 중 표출된 법 관념에 관한 기존 연구들은 법치로의 전환이 진행되고 있었다는 시각에 경도되어 이 경로 밖의 상황을 간과하는 경향이 있다. 본 연구에서는 당시 운동 과정에서 서양의 법 관념이 의식되고 있었으면서도 실제로는 법치로 수렴되지 않는 다양한 양상이 나타났음에 주목한다. 특히 서양문명을 중시하던 운동의 주도세력이 법의 중요성을 강조하기 위해 유교적 담론을 동원하던 상황, 의회 설립 운동 과정이나 입헌과 비교될 수 있는 실천 과정에서 법을 문명화와 정치를 위한 도구로 활용하던 상황, 대중적 정치운동 과정에서 법치적 요구가 주변화되던 상황에 유의하며 그 의미를 탐색한다. 이러한 작업은 단지 연구사에서 누락된 부분을 채우기 위한 것만은 아니다. 여기에서 더 나아가 서양으로부터 법 관념이 수용되고 있었다는 사실만으로 근대화의 방향을 예단하는 것은 적절하지 않음을 지적하는 것 역시 본 연구의 중요한 목표이다. 새로운 지식과 제도가 소개되던 양상뿐만 아니라 이들이 기존의 정치적, 사회적, 문화적 조건과 상호관계를 맺으며 독특하게 전개해간 양상에도 충분히 주의를 기울일 필요가 있다는 것이다.

영문 초록

Previous studies of legal ideas expressed during the enlightenment and political movements led by Tongnip Sinmun(The Independent) and the Independence Club in the late 1890s have tended to favor the view that a transition to the rule of law was underway. In contrast, this study shows that although the leaders of the movements were strongly conscious of Western legal ideas, there were various aspects of the enlightenment and political movements that did not converge towards the rule of law. In this article, we pay special attention to such circumstances as follows: those in which movement leaders, aspiring to the West, mobilized Confucian discourse to emphasize the importance of law; in the course of movements to establish parliaments, and in practices that can be compared to constitutional movements, in which law was seen as a tool for civilization and politics; and in the course of popular political movements, in which demands for the rule of law became increasingly marginalized. This work does not merely fill a gap in previous research. An important goal of this work is to point out that it is not appropriate to prejudge the direction of modernization based on the fact that legal ideas were being adopted from the West. It is necessary to pay attention not only to the ways in which new knowledge and institutions were received, but also to the ways in which they interacted with existing Korean political, social, and cultural conditions, and eventually developed in a unique manner.
