매 맞는 노비와 윤리/교양의 역설

국문 초록

이 논문은 이문건의 『묵재일기』에 기록된 노비의 체벌과 관련된 서술의 수집과 분류, 분석을 통해 노비 체벌에 전제된 노비의 의무와 규범을 재구성함으로써, 역설적으로 조선시대 노비의 역량과 자질, 덕목과 교양, 윤리의 실재를 해석학적으로 규명했다. 노비는 노주로부터 명령에 대한 복종, 성실성, 양질의 노동 품질과 빠른 속도, 세심한 육아 태도, 기물 파손 금지, 노주의 취향과 요구에 대한 적절한 응대, 위험 관리 등을 요구받았으며, 근면, 신중, 조심스러움, 예의, 공손, 돌봄, 신뢰, 가족 및 동료에 대한 등의 예의 바른 태도와 언어생활, 윤리 등을 요청받았다. 노주는 노비의 사귐, 다툼, 강간, 간통 등 개인적, 신체적, 성적 부분에 관여했으며, 노비를 통해 감정을 해소하거나 투사하는 등 감정 노동의 수혜를 받았다. 노비는 대체로 노주의 체벌을 일방적, 수동적으로 감내했지만, 때때로 언어와 행동의 차원에서 맞서거나 노주의 부재시나 사후(事後)에 노주를 비판하고 명령을 회피하는 등 노주와의 교섭과 저항, 조율을 시도했다. 노비에 대한 노주의 체벌은 역설적으로 노비의 역량과 자질, 윤리와 교양을 노주가 인정했음을 시사한다. 그러나 신분적 위계가 노비에 대한 정당한 인정구조를 형성하지 않는 요인으로 작용했으며, 일상생활에서 노비 스스로도 명확한 자기 인식을 단련하고 이에 대한 성찰적 이해를 공론화하지 못했다. 이 연구에서는 이를 신분제 사회에 노비의 윤리/교양의 역설로 명명하고, 교육 없는 교육, 문화 없는 문화, 명명 없는 실재의 해석을 통해, 문자화되지 못한 노비의 정체성, 일상, 관계, 감각과 능력의 실재에 대해 사유하는 계기를 제안했다.

영문 초록

In this paper, by collecting and analyzing the sentences which were narrated the corporal punishment of slaves recorded in the Mukjae diary written by Yi Mun-geon, the duties and norms of the servants and bondmaids (nobi) premised on the corporal punishment were reconstructed. Paradodxically, the reality of the competence and qualities, virtues, culture, and ethics of slaves in the Joseon Dynasty was identified hermeneutically through this. Nobi was asked by the old owner to obey orders, sincerity, quality and speed of labor, careful parenting, prohibition of property damage, proper response to the old owner’s tastes and needs, and safety. In addition, polite attitudes and speaking, and ethics such as diligence, sincerity, prudence, courtesy, politeness, care, trust, family and colleagues were requested. The slaves also controlled their personal, physical, and sexual aspects, such as relationships, quarrels, rape, and adultery, and the yangban owners were benefited from emotional labor such as resolving or projecting emotions through the slave. Nobi generally accepted the owner’s physical punishment, but sometimes resisted with speaking and behavior, and tried to coordinate with their owner while negotiating with him. Paradoxically, the servants and bondmaids’ physical punishment for the other slaves suggests that the servants’ competence and qualities, ethics, and culture were recognized by the slaves. However, this did not form a legitimate recognition structure in the hierarchical perception of status. In this study, the possibility and point of debate were analyzed by naming this as the paradox of slave ethics/culture in the status system society.
