예술을 활용한 법교육 방안 탐색

국문 초록

본 연구의 목적은 법교육에서 예술을 활용하는 것의 필요성을 밝히고, 구체적인 방안을 탐색하는 것이다. 법교육은 학생들이 단순히 법적 지식을 습득하는 것에 그치지 않고 법적 사고력과 법에 대한 긍정적인 법의식을 함양하는 것을 지향한다는 점에서 창의력과 상상력, 통찰력 등을 필요로 한다. 그러나 기존의 법교육은 복잡한 법적 지식을 전달하는데 치중하여 학생들의 흥미를 이끌어내지 못하고 가치교육으로서의 역할을 제대로 하지 못한다는 비판을 받아 왔다. 법교육에 있어서 예술의 활용 및 적용은 기존의 사례, 내용 중심의 법교육이 가지는 한계를 극복하고 융합적 인재를 양성하는데 기여할 수 있을 것으로 기대된다. 본 연구에서는 관련 연구를 검토하여 법교육에서 그림, 사진, 음악, 춤 등 다양한 형태의 예술을 활용하는 것이 필요하고, 예술을 수업의 소재·자료로 활용하는 것과 함께 활동·표현으로 활용하는 것이 필요함을 확인하였다. 또한 법교육에서 예술을 활용할 때 인지적·맥락적 적합성, 법교육 핵심 내용과의 연관성, 상호 보완적 활용을 고려한 접근이 필요함을 확인하였다. 이를 바탕으로 예술을 활용한 법교육 교수-학습 방안의 예시를 탐색하고, 대표적 사례로 시각예술을 활용한 법교육, 문학작품을 활용한 법교육, 영화를 활용한 법교육의 교수-학습 방안의 예시를 각각 구체적으로 제시하였다. 본 연구의 논의를 바탕으로 법교육에서 예술 활용이 보다 활발하게 실현될 수 있기를 기대한다.

영문 초록

This study aims to clarify the need for the use of art in law-related education and to explore specific ways. Law-related education requires creativity, imagination, insight, etc, in that it aims not only to acquire legal knowledge but also to cultivate legal thinking ability and positive legal awareness of law. However, traditional law-related education has been criticized for focusing on conveying complex legal knowledge and failing to attract students’ interest and serve as a value education. The use and application of art in law-related education is expected to contribute to overcoming the limitations of existing cases and content-oriented law-related education and fostering convergent talents. In this study, it was confirmed that it is necessary to use various forms of art such as painting, photography, music, and dance in law-related education, and to use art as a material for class and as an activity and expression. In addition, it was confirmed that when using art in law-related education, it is necessary to take an approach that considers cognitive and contextual suitability, relevance to the core content of law-related education, and complementary use between various arts. Based on this, examples of law-related education teaching and learning methods using art were explored, and specific examples of law-related education using visual art, law-related education using literary works, and law-related education using movies were presented, respectively. It is hoped that the use of art in law-related education can be realized more actively based on the discussion of this study.
