건설업 적격수급업체 선정을 위한 안전보건 수준 평가 문제점 및 개선방안

국문 초록

2022년 1월「중대재해처벌법」시행이 후 경영책임자의 안전보건 확보 의무에 대한 책임이 강화되었지만, 건설 산업의 중대 산업재해는 여전히 감소하지 않고 있으며, 주된 이유는 원도급사에만 산업재해 예방에 대한 책임과 제도가 집중되어 있다는 점이다. 건설현장의 종사자를 직접 고용하고 작업 지휘하는 하수급업체에서는 산업재해 예방을 위한 안전보건관리체계 구축의 필요성에 대한 위한 인식과 노력이 부족한 게 현실이며, 하수급업체의 안전보건 역량과 수준을 높일 수 있는 제도를 마련하여 운영할 수 있는 체계가 필요하다. 「중대재해처벌법」시행령 제4조 제9호에서는 하수급업체의 안전보건 역량 확보에 대해 기준과 절차를 수립하기 위한 체계로 적격수급업체 선정을 위한 ‘안전보건 수준 평가제도’를 운영하여 산업재해 예방 능력이 있는 하수급업체를 선정하기 위함이다. 현재 민간건설업체에서 이 제도를 자체적으로 운영하고 있지만 명확한 법률 규정과 기준이 없어 전문성과 신뢰성이 부족하여 효율성이 낮게 나타나고 있다. 본 연구에서는 건설업 ‘안전보건 수준 평가제도’운영에 대한 문제점을 파악하여 개선방안을 제시하기 위함이다. 이에 민간 건설업체의 ‘안전보건 수준 평가제도’의 운영실태를 검토하고, 선행연구와 공공기관에서 운영하는 건설업 원도급사에 대한 안전 평가제도 실태조사와 전문가 인터뷰 조사를 통한 설문조사를 위한 선정지표를 선정하였다. 설문조사 후 AHP(Analytical Hierarchical Process) 분석 방법으로 ‘안전보건 수준 평가제도’ 운영 개선방안에 대하여 우선순위를 선정하여 건설업 하수급업체에 대한 신뢰성과 공정성이 확보된 표준화된 ‘안전보건 수준 평가제도’ 운영 방안을 제시하였다.

영문 초록

Since the enforcement of the Act on the Punishment of Severe Disasters in January 2022, the responsibility for the CEO's obligation to secure safety and health has been strengthened, but serious industrial accidents in the construction industry have not decreased. one of the main reason is that only the original contractors are only focused on the responsibility and systems for preventing industrial accidents, and subcontractors who directly hire and direct construction workers lack awareness and efforts to establish a safety and health management system to prevent industrial accidents. Therefore, there is a need for a system which can prepare and operate a system that can increase the safety and health capabilities and level of subcontractors. In Article 4, No. 9 of the Enforcement Decree of the above Act requires a system to establish standards and procedures for securing safety and health capabilities of subcontractors to select subcontractors capable of preventing industrial accidents. Currently, private construction companies operate their own “Safety and Health Level Evaluation System”, while there are no clear legal regulations and standards, resulting in low efficiency due to lack of expertise and reliability. This study aims to identify problems in operating the safety and health level evaluation system in the construction industry and suggest improvement measures. Accordingly, the operation status of the safety and health level evaluation system of private construction companies was reviewed, and some indicators were selected for surveys through previous studies and survey of the safety evaluation system for construction worker contractors operated by public institutions. With the survey, the importance priority was derived by the AHP analysis method, and a plan to operate the safety and health level evaluation system of construction subcontractors in a standardized method with reliability and fairness was proposed.
