국문 초록

현대사회에서는 여성의 사회활동이 일반적인 것으로 인식되고 있다. 오늘날 대부분의 여성은 고학력이며, 이들은 사회에서 활발히 활동하기를 원하고 있다. 그러나 여성의 사회 활동은 남성 보다 여러 가지로 제약을 받는 경우가 많이 있으므로, 이들이 사회에서 안정적으로 적응할 수 있도록 국가는 협력할 필요가 있다. 물론 여성의 사회활동에 대하여 직접적으로 지원하는 경우도 있지만, 세금 등을 통하여 간접적으로 지원하는 방안도 적극적으로 모색할 필요가 있다. 여성의 지위향상을 위한 여성정책이 추진되고 있기는 하지만, 여성세제와 관련된 법은 여전히 기존의 고정관념에 기반하고 있어 변화하는 시대를 반영하지 못하고 있다. 여성의 사회참여율이 적고 사회적 지위가 취약한 현재의 기반에서는 여성이 자체적으로 해결할 수 있는 능력에는 한계가 있는 만큼 원숙한 사회분위기가 조성될 때까지는 단순히 양성의 평등 이라는 법리적 접근보다는 여성이 사회활동에 적극 참여할 수 있도록 장애물을 제거해주고 지원육성을 위해서 보다 현실적이고 합리적인 정책의 입안 또는 법의 개정․신설의 노력이 필요하다 하겠다. 이 논문의 목적은 이러한 시대의 흐름에 상충하는 세법상의 문제점을 제시하여 이를 개선하도록 함으로써 여성의 사회진출의 기회확대와 활동의 폭을 넓히는데 기여하려는 것이다. 구체적으로 이 연구에서는 여성이 사업을 하든지 아니면 취업을 하는 경우 남성에 비하여 차등을 받지 아니하고 오히려 지원을 통해 사회활동을 적극적으로 수행할 수 있는 간접지원책인 바람직한 조세개편 방안을 다음과 같이 제시하고자 한다. 첫째, 여성 창업에 관한 세제의 개선 방안으로는 여성으로서 기업을 경영하기 어려운 현실을 감안하여 여성이 경영하는 기업에 대하여 여성사업자세액공제 또는 감면제도를 신설한다. 둘째, 취업여성의 모성지원제도를 강화하여 안정적인 사회활동을 유도한다. 그러기 위해서는 미흡한 육아시설이 충분히 확대되어야 된다. 이 시설의 신축 또는 구입 시에 현행 당해 시설의 취득금액 7/100 에 상당하는 금액을 공제하는 법규에서 공제율 10/100으로 상향 조정한다. 아울러 현행 부녀자 세대주 공제제도는 여성의 일부에 한정되고 있으나, 여성의 적극적인 직장생활로 사회참여가 이루어지기 위해서는 모든 직장 여성에게 세제혜택이 주어질 수 있도록 법을 개정함이 바람직하다고 본다.

영문 초록

In contemporary society, social activities of women are taken for granted in general. Admittedly, it is no more wonder to find lots of highly educated women who are active in all walks of life. There is no denying the fact, however, that women have been treated with more limitation in their scope of activities than men, a cause the government should intervene with to enable women to be safely settled in the society. Effective schemes to this end shall include indirect supports with, for instance, tax favors, not to speak of direct incentives for their social activities. As long as women’s participation in the social arena remains inactive and their social status stays fragile, they would continue to find themselves tied up with their ability to solve problems unaided. It is therefore solicited to work out reasonable as well as practical policies or enact and revise laws to help women eliminate various barriers and activate social participation, instead of solely legal approach to the equal right of both sexes, until the infrastructure for actual equality of both sexes is fully mobilized. The present study aims to spotlight the problems of tax laws that swim against the current of the times and to suggest means to improve them, contributing by thus to widening chances for women to advance in society and act for its growth and cultivation. In detail, following plans for restructuring tax system, as indirect aids, are proposed to encourage women to perform social activities more actively without unfair treatment compared to men in fields of business or employment. First, as an improvement measure to assist women by taxation, tax should be exempted or reduced for businesses launched by women in consideration of difficulties they may face in real business world. Second, maternal support system should be reinforced to back up women to perform social activities in stable conditions. For this purpose, the present poor-scale day-care centers should be expanded to the full extent. The tax exemption rate should be increased from the current 7/100 of the acquisition amount for purchase or construction of the facilities to 10/100. In addition, it is most desirable to revise the laws so that the tax exemption for women householders that is currently applied in the limited terms should be expanded to all working women in a bid to motivate them to engage in job careers actively and freely.
