국문 초록

이 논문에서는 경찰의 범죄피해자 신변보호의 문제점과 대책을 알아보았다. 문제점으로는 첫째, 가해자를 강제로 격리시킬 수 있는 법령이 미흡하다는 것이다. 둘째, 아무리 경찰이 빨리 출동한다고 하더라도 순식간에 이루어지는 범행을 모두 막을 수는 없다는 것이다. 셋째, 신변보호를 전담하는 부서가 없어서 전문성이 떨어진다는 것이다. 넷째, 스마트워치의 위치추적시스템이 정확한 장소를 찾기가 힘들다는 것이다. 대책은 첫째, 가해자에 대해서 선제적으로 격리할 수 있는 법령의 제정과 구속사유로서 재범의 위험성과 피해자 등 위해 우려를 추가할 필요가 있다. 둘째, 가해자에 대한 위치추적GPS감시시스템의 도입이 필요하다. 가해자가 피해자에게 일정범위내로 접근하면 경찰과 피해자에게 경고를 해줌으로써 미리 가해자를 피할 수 있게 한다면 범죄를 예방할 수 있을 것이다. 셋째, 경찰이 모든 신변보호를 다할 수 없기 때문에 민간경비업체와의 협업이 필요하다.

영문 초록

In this thesis, the problems and countermeasures of the personal protection of crime victims by the police were investigated. The problem is, first, that the laws that can force the perpetrators to isolate are insufficient. Second, no matter how quickly the police arrive, they cannot stop all crimes in an instant. Third, there is no department in charge of personal protection, so professionalism is low. Fourth, it is difficult for the smart watch s location tracking system to find the exact location. First, it is necessary to enact laws that can preemptively isolate offenders, and to add concerns about the risk of recidivism and harm to victims as a reason for arrest. Second, it is necessary to introduce a location tracking GPS monitoring system for the offender. If the perpetrator approaches the victim within a certain range, it will warn the police and the victim so that the perpetrator can be avoided in advance, thereby preventing crime. Third, since the police cannot provide all personal protection, cooperation with private security companies is necessary.
