강간과 외상후스트레스장애 사이의 합법칙적 조건관계의 판단과 객관적 귀속가능성

국문 초록

우리 대법원은 다수의 판결에서 강간행위와 피해자의 외상후스트레스장애 사이의 인과관계를 인정한 바 있다. 그러나 인과관계를 인정하기 어려운 많은 의학적 이유들이 존재한다. 그렇다면 강간치상죄의 상해는 결과반가치가 아니라 피해여성에게 외상후스트레스장애를 가져오게 한 점에 대한 결과책임을 부담지우는 것이기 쉽다. 결과책임이 아니라면 강간치상의 치상은 객관적 표지가 아니라 마치 행위시점에서 행위자에게 “피해여성에게 나중에 외상후스트레스장애가 발생할지도 모른다는 점에 대한 (잠재적) 의식”과 같은 주관적 표지로 변질시키는 것이 된다. 이 주관적 표지는 흔히 행위반가치로 볼 수도 있지만, 강간행위양태로서 지각가능한 것이 아니기 때문에 사실상 심정반가치의 요소로 기능한다고 볼 수 있다. 결국 언론을 통해 강간피해여성의 외상후스트레스장애에 관한 정보를 갖고 있는 가해자라면, 그런 심정반가치는 있다고 보게 되고, 그의 강간행위는 곧 강간치상(상해)행위가 되는 것이다. 본 논문은 합법칙적 조건설에 의해 기본행위와 중한결과 사이에 인과관계를 판단하고, 객관적 귀속론에 의해 결과의 귀속가능성을 판단해 보고자 한다.

영문 초록

The Supreme Court said, The victim showed symptoms such as anxiety, insomnia, nightmares, self-criticism, depression, avoiding interpersonal relationships, indifference to daily life, and loss of interest due to rape. These symptoms correspond to post-traumatic stress disorder, a special psychological symptom that occurs after experiencing a psychological shock in extreme threatening events that cannot be medically experienced under normal circumstances. The victim admitted that he/she took treatment for two days due to such symptoms, required six months of treatment, and the above symptoms experienced by the victim cannot be said to be inevitable symptoms of all victims of rape, so the victim suffered injuries prescribed by Article 9 (1) of the above Act. The crime of rape and bodily injury is aggravated by the violation of the legal interest of health (physiological function) in addition to the violation of the legal interest of sexual self-determination in the process of sexual assault. This paper attempts to examine whether the causal relationship between rape behavior and post-traumatic stress disorder is recognized.
