국문 초록

데이터나 인공지능은 모든 산업 분야에서 경쟁력의 원천이 되고 있으며, 그 효과적인 활용은 국가와 산업의 발전에 큰 영향을 주고 있다. 데이터·AI를 효과적으로 이용·활용하기 위해서는 적절한 권리보호와 그 이용을 저해하지 않는 제도가 갖추어져 있어야 할 것이다. 나아가 디지털 트윈 컴퓨팅의 효과적인 이용·활용을 목적으로 한 저작권법상 논의가 국내에서도 필요한 때이다. 이 논문에서는 휴먼 디지털 트윈 컴퓨팅과 저작권법의 관계를 다루기 위한 시도를 했으며, 다음과 같은 시사점을 도출했다. 첫째, 데이터 및 AI의 이용이 활발해지는 사회 추세에 맞춰서, 국내 저작권 법리의 재검토 및 정리가 필요하다. 저작권의 존재가 AI 관련 기술개발에 지장이 줄 가능성을 줄이는 방안을 마련할 필요가 있다. 이를 위해 관련 규정을 저작권법에 명시하는 것이 가장 효과적인 방안이다. 둘째, 휴먼 DTC에 관한 검토 시, 휴먼 DTC가 그 바탕이 된 인간을 –사상이나 감정을 포함하여- 얼마나 재현할 수 있는지, 휴먼 DT는 어느 정도 자율적으로 행동할 수 있는지와 같은 부분들을 명확히 한 후에, 그 수준에 따른 단계별 검토를 하는 것이 관련 논의에 도움이 된다. 셋째, 사상이나 감정을 포함하여 재현된 휴먼 DT를 검토하는 경우, 원래 ‘사상이나 감정’이란 무엇인지, 휴먼 DT가 기술적으로 어떻게 사상이나 감정을 재현하고 있는지에 대한 검토가 필요하다. AI와 휴먼 DTC의 발전이 저작권법을 지지하는 3대 개념(저작물, 저작자, 저작권) 중 저작물과 저작자의 정의에 관하여 근본적인 물음을 던지고 있기 때문이다.

영문 초록

Data and artificial intelligence(AI) are a source of competitiveness in all industries, and their effective use has a great influence on the growth of countries and companies. In order to effectively use and utilize data and AI, it is necessary to have a system that does not impede proper protection of rights and their use. Furthermore, discussions on the Copyright Law aimed at effective use and utilization of digital twin computing(DTC) are also needed in Korea. In particular, this paper dealt with the relationship between human DTC and the Copyright Law, and drew some implications as in the following. First, it is necessary to review and organize korean Copyright Law in line with the social trend of active use of data and AI. By acknowledging the free use of works worldwide, measures should be prepared to reduce the possibility that the existence of copyright will interfere with AI-related technology development. The most effective way is to legislate relevant regulations in the Copyright Law. Second, when reviewing a human DTC, it is desirable to conduct a step-by-step review of the human DTC based on such parts as how much it can reproduce thoughts or emotions and how autonomous it can act. Third, when reviewing reproduced human DT, it is necessary to review what is originally ‘thoughts or emotions’ and how human DT technically reproduces thoughts or emotions. This is because the development of AI and human DTC raises fundamental questions about the definition of ‘work’ and ‘author’ among the Copyright Law.
