국문 초록

1951년 6월 20일 미8군부사령관 John B. Coulter 중장은 대한민국 국무총리에게 독 도폭격연습기지 사용 인가를 신청한 바 있다. 미8군부사령관은 미국의 국가 기관이고 동 인가신청의 주체는 법인격자인 미국이다. 미국이 대한민국정부 당국에 독도폭격연습기지의 사용을 인가해 줄 것을 요청한 것은 미국이 대한민국의 독도영토주권을 묵시적으로 승인한 것이다.영토주권의 승인은 국제법상 금반언의 효과를 창출하므로 미국은 대한민국의 독도영토 주권의 승인과 모순⋅저촉되는 행위를 하지 아니할 국제법상 의무를 부담한다. 그럼에도 불구하고 미국은 “대일평화조약”의 체결과정에서 Sebold의 “대일평화조약”안 에 대한 1949년 11월 4일의 권고적 의견에 따라 1951년9월 8일의 “대일평화조약”에서 독도를 대한민국의 영토로 명시적으로 규정하지 아니한 것에 대해 국제법상 정치적⋅법적 책임을 부담한다. 한국 정부는 미국에 의한 한국의 독도영토주권의 승인을 국제관계에 있어서 외교정책에 반영하고 대일외교정책에도 반영하여야 한다.

영문 초록

General, United States Army, Deputy Army Commander Eighth United States Army Korea, requested to use Dokdo(Liancourt Rocks) Bombing range to Chang Myun Prime Minister Republic of Korea, on 20 June, 1951. General Coulter is an organ of the United States. Therefore his request is a request of the United states and the request means the implied recognition of the Korean territorial sovereignty over Dokdo in international law that produces legal effect of the estoppel In spite of the legal effect of the recognition the Government of the United states did not stipulates the Dokdo as an island of the Korean territory in Draft Peace Treaty with Japan after Sebald’s recommendation on November 8, 1951. As a result of the Government of the United States Policy to accept Sebald’s recommendation, the Government violates the legal effect of international law of recognition, that is to say, estoppel. On account of the legal effect, the Government of the United States burdens not only political responsibility but also legal responsibility in international law. It is necessary for the Korean Government to reflect the legal effect of the recognition of the Korean territorial territory sovereignty over Dokdo by Government of the United States, in diplomatic Policy in international relations
