형 집행정지 제도의 문제점과 개선방안

국문 초록

형 집행정지 제도는 징역․금고․구류형이 확정되어 교도소(구치소) 등에서 형 집행 중, 일정한 사유로 형 집행을 잠정적으로 정지시키는 제도이다. 현행 형 집행정지 제도의 문제점으로는 형사소송법 제471조 제1항 제2호 사유(연령이 70세 이상인 자)의 불필요성, 형 집행정지 제도의 남용 문제, 형 집행정지 신청 대상자의 형평성 문제, 획일적인 형 집행정지 기간으로 인한 형 집행정지의 탄력성 약화, 형 집행정지 결정의 취소에 따른 잔형 집행의 어려움, 형 집행정지 결정시 부가조건의 미흡으로 인한 잔형 집행의 면탈을 불러올 소지가 있다. 개선방안으로는 형집행정지 심의위원회에서 안건에 대한 충분한 검토와 심의, 형 집행정지 기간의 세분화로 제도 운용의 효율성 도모, 형사소송법 제471조 제1항 제2호(연령이 70세 이상인 때) 삭제, 형 집행정지 취소사유의 보완, 동일한 사유로 반복적 신청에 대한 각하 사유의 신설, 무연고자나 가족 등이 형 집행정지자의 신병 인수를 거부할 때 공공 보호시설이나 의료시설이 인계할 수 있는 규정도 신설하여야 한다. 더 나아가 형 집행 개시 전에 형 집행정지 결정을 할 수 있는 규정의 신설, 형 집행정지결정이 취소된 경우, 신속한 잔형 집행, 형 집행정지 결정시 추가적인 부가요건 부여, 형사소송법 제471조 제1항 제7호 사유로 형 집행정지 결정된 자에 대한 형 집행불능 결정에 준하는 사유 신설, 노역장 유치집행 정지사유도 추가로 마련하여야 한다.

영문 초록

Stay of sentence execution is a system to suspend execution of sentence provisionally for specific reasons in the course of sentence execution in prison (detention center) after decision of sentence of prison labor․imprisonment․detention etc. Among the problems of the current stay of sentence execution are unnecessity of the reason in the Item 2 (those aged over 70), Clause 1, Article 471 of the Criminal Procedure Code, abuse of stay of sentence execution, fairness between stay of sentence execution applicants, weakening of the flexibility of stay of sentence execution due to standardized period of stay of sentence execution, difficulty in execution of remaining prison term caused by the cancellation of decision for stay of sentence execution, possibility to cause evasion of the execution of remaining prison term due to insufficiency of additional conditions at the time of decision for stay of sentence execution. Improvement plans include sufficient examination and deliberation of agenda at the stay of sentence execution deliberation committee, promotion of the efficiency of operation by subdividing the period of stay of sentence execution, deletion of the Item 2 (those aged over 70), Clause 1, Article 471 of the Criminal Procedure Code, supplementation of the reason for cancellation of stay of sentence execution, establishment of a reason for rejecting repetitive application submitted for same reasons, establishment of regulation for enabling public protective or medical facilities to take over offenders without family or friends, or when family refuses to take in the offender. In addition to the aforementioned, establishment of regulation that enables decision for stay of sentence execution prior to commencement of execution of sentence, fast execution of remaining prison term in case decision for stay of sentence execution is cancelled, imposition of additional conditions at the time of decision for stay of sentence execution, establishment of reasons in proportion to the decision of impossibility of enforcement for those who have been notified for stay of execution of sentence for the reason of the Item 7, Clause 1, Article 471 of the Criminal Procedure Code and reason for stay of detention in a workhouse shall also be prepared.
