국문 초록

말레이시아는 동방정책을 시행한 이래 경제성장에 성공한 사례이다. 최근 말레이시아는 이슬람부흥운동이 활발한 국가이며, 다인종, 다문화국가이다. 말레이시아의 2대 인종집단은 말레이계 원주민과 중국계 華人집단이다. 이들은 1969년 인종폭동이후 정치적으로는 잘 지내고 있으나, 경제적으로는 서로 협력하지 않는 특성을 보이고 있다. 말레이시아는 이슬람이 주요 종교인 관계로 이슬람법인 샤리아법에서 전통적으로 내려오는 분쟁해결제도를 갖추고 있다. 말레이시아는 영국의 식민지 시절에 계수한 보통법과 주로 결혼, 이혼, 상속 등, 가족법 관련 분쟁을 담당하는 샤리아법원의 이중구조로 이루어져 있다. 샤리아법원에서는 조정에 가까운 sulh, 중재에 해당하는 tahkim, 조정-중재에 해당하는 분쟁해결제도를 갖추고 있다. 이처럼 말레이시아는 다양한 ADR제도를 갖추고 있다. 또한 현대에 이르러서는 법원연계형 조정 등 다양한 조정제도를 통하여 조정을 시행하고 있으며, 쿠알라룸푸르중재센터 등에서 중재를 행하고 있다. 말레이시아의 비즈니스협상 문화는 권위존중 문화이며, 예의 존중문화, 그리고 의사소통에 있어서 고맥락 문화의 특징을 보이고 있다.

영문 초록

Malaysia has witnessed rapid economic growth for a couple of decades due to the inward foreign direct investment. Concomitantly, the number of disputes with trading partners also increases. This study shows that Malaysian dispute resolution system, employing various channels has been inherited from Islam Shariah law court: Suhl(mediation), Tahkim(arbitration) and Fatwa of Muftis (Expert determination) and others. Secondly, this study illuminates the various institutions of alternative dispute resolution(ADR) in Malaysia. In modern Malaysia, there are diverse kinds of institutions in order to provide alternative dispute resolution(ADR) to disputants. One notable example is Kuala Rumpur Court Mediation Center(KLCMC). KLCMC encourages disputants to settle the disputes through mediation instead of litigation. Thirdly, this study shows that Malay people has characteristics of generosity, and have a strong feeling of shame. Furthermore, Malay people as well as other Southeast Asian peoples tends to shows the propensity to respect the high ranking official such as King.
