국문 초록
서비스무역에 관한 일반협정(General Agreement on Trade in Services: GATS)은 보조금에 특정한 규범을 두고 있지 않다. GATS는 제ⅩⅤ조를 통하여 회원국에 서비스 보조금에 관한 규범을 협상할 것을 지시하고 있다. 동 규정에 따르면, 회원국은 특정 상황에서 보조금이 서비스무역을 왜곡하는 효과를 가질 수 있다는 것을 인정한다. 또한, 동규정은 회원국이 이러한 무역왜곡효과를 방지하기 위하여 필요한 다자간 규율을 발전시켜 나가기 위한 협상을 개시하여야 한다고 규정하고 있다. 또한, 이 협상에서는 상계절차의 적절성 문제를 다루어야 한다. 이러한 협상은 개발도상국의 개발계획과 관련한보조금의 역할을 인정하며, 또한 이 분야에서의 융통성에 대한 회원국, 특히 개발도상회원국의 필요를 고려하여야 한다. 아울러 이 규정은 협상의 목적을 위해 회원국이 자국 국내 서비스공급자에게 제공하는 서비스무역과 관련된 모든 보조금에 대한 정보를교환하도록 하고 있다.
현재의 GATS 규정은 서비스 보조금을 실질적으로 규율함에 있어 많은 한계를 갖고있다. Ⅱ.에서는 서비스무역에 있어서의 보조금을 정의함에 있어서 고려되어야 할 사항들을 검토하고, Ⅲ.에서는 서비스 보조금에 대한 상계관세 부과의 가능성을 살펴본다.
서비스 보조금을 정의함에 있어서는 서비스의 공급방식과 영역의 문제가 충분히 고려되어야 한다. 모드 1과 모드 2와 비교하여 모드 3과 모드 4의 경우 보조금에 의한 무역왜곡효과가 발생하였는지를 판단하는 것이 한층 더 어렵다. 많은 국가들이 투자 유치를 위한 인센티브를 제공하고, 자연인의 주재에 관한 다양한 규제를 두고 있는 상황에서 외국의 보조금이 모드 3과 모드 4를 통한 서비스 공급에 미치는 효과를 어떻게 판단하여야 할지가 뚜렷하지 않기 때문이다. 이러한 공급방식과 영역의 문제는 상계조치의적용, 특히 상계관세의 부과에 대해서도 영향을 미친다. EU의 한 제도와 사례를 보면,서비스에 대한 상계관세가 모드 1을 통한 서비스 공급에 대해서는 적용될 수 있으나 모드 2를 통한 서비스 공급에 대해서는 적용하기 어려울 것으로 보인다. 또한, 이 사례에서는 국내산업의 범위에 해당 영역 내에 설립된 모든 사업자를 포함시켜 모드 3을 통한서비스 공급과 국내산업 간 구분을 시도하고 있지 않다. 또한, 상계관세의 부과에 있어서는 서비스가 무형이라는 점이 중요하게 작용한다. 서비스에 대한 상계관세를 부과하기 위해서는 해당 서비스가 다루는 유형의 물품 또는 고객을 매개로 하여야 하는데 이때에는 GATS 및 WTO협정의 다른 의무와 상충될 가능성이 높다. 따라서 향후 진행되는협상에서는 이러한 충돌에도 불구하고 일방적 구제조치인 상계조치를 인정할 필요성에대한 검토가 필요하다.
영문 초록
WTO General Agreement on Trade in Services(GATS) does not includedisciplines specifically governing subsidies made to services or service suppliers.
The agreement merely includes a provision(Article XV) that mandates theMembers to negotiate such disciplines. Article XV provides as follows: “Membersrecognize that, in certain circumstances, subsidies may have distortive effects ontrade in services. Members shall enter into negotiations with a view to developingthe necessary multilateral disciplines to avoid such trade-distortive effects. Thenegotiations shall also address the appropriateness of countervailing procedures.
Such negotiations shall recognize the role of subsidies in relation to thedevelopment programmes of developing countries and take into account theneeds of Members, particularly developing country Members, for flexibility in thisarea. For the purpose of such negotiations, Members shall exchange informationconcerning all subsidies related to trade in services that they provide to theirdomestic service suppliers.”In Parts II and III, this article explores the elements for defining servicessubsidies and the issue of applying countervailing duties on services. It is pointedout that the issue of mode of supply and territory should be fully consideredin defining services subsidies. When subsidized services are supplied throughmodes 3 and 4, it is difficult to determine whether this has created trade-distortingeffect in international trade, even more complicated than when the subsidizedservices are supplied through modes 1 and 2. This is due to the situation wherethe investment- importing States often provide investment incentives to invitecommercial presence, or where the mode 4 importing States impose variousregulations on presence of natural persons. This issue of mode of supply andterritory also affects how countervailing duties would be imposed. An analysisof a relevant EU regime and case shows that countervailing duties on servicescould be imposed in the situation of mode 1 supply whereas in the situationof mode 2 supply, it would be very difficult to impose such duties in the similarway as applied in the mode 1 situation. In the same case, the investigatingauthorities included in the scope of domestic industry all suppliers established within its territory, thereby not distinguishing between the mode 3 servicessuppliers and the domestic industry. The fact that services are intangible playsanother part in the imposition of countervailing duties on services. Such dutiesneed to be imposed on the goods or customers in which the services at issuematerialized, which could create conflicts with other provisions in GATS or inother WTO Agreements. Accordingly, the future negotiations should discusswhether countervailing duties mechanism is reasonable and relevant as a remedyfor services subsidies, despite these possible conflicts.
