국문 초록

이 논문은 심판변론인 자격ㆍ등록제도에 대해 헌법상 직업선택의 자유와 평등권, 무기대등(평등)의 원칙을 적용시켜 고찰했다. 아울러, 심판변론인 자격시험, 심판변론인 양성 교육기관, 심판변론인선임 강제주의 등 심판변론인 법제 개선 방안에 대하여 논하였다. 현재 우리나라에서 해양사고를 심의하고 징계수위를 결정하는 해양안전심판원과 관련하여, 심판변론인의 자격 요건을 볼 때 법률적 요소에 비해 기술적 요소에 많은 비중을 두고 있음을 알 수 있는데, 심판변론인의 저조한 선임율에 대한 이유를 여기에서 찾아볼 수 있겠다. 이 논문은 일정한 자격요건을 갖춘 자가 등록만 함으로써 심판변론인의 자격을 취득하는 현행 심판변론인 자격 및 등록제도는 이에 대한 해결책이 될 수 없다고 보며, 결국 해양안전심판원에서 변호사와 유사한 역할을 하는 심판변론인은 사회적 기준을 충족하는 국가고시와 같은 공개적 선발기준을 통하여 선발하고 아울러 실무 교육함으로써, 일종의 전문직업인으로 활동할 수 있는 발판을 마련해주는 것이 전문적인 심판변론인의 양성 및 활성화 방안이 될 수 있다고 주장한다.

영문 초록

This article has discussed the matter of the current marine-counsellor’s qualification and registration system in the light of freedom of career choice, rights to equality and the principle of equality of weapons and given some recommendations for policies such as the invention of an examination for the marine-counsellor’s license, the establishment of an institution for the marine-counsellor’s training and eduction, and the introduction of a mandatory marine-counsellor system. With regard to the current maritime safety administrative adjudication examining the causes of maritime accidents and imposing penalty on the holder of the marine officers’ license, qualification requirements of the marine-counsellor are focussed more on technical aspects than on legal aspects. This may lead to a low marine-counsellor designation rate. This article argues therefore that the current system whereby particular persons meeting marine-counsellor registration requirements become the marine-counsellor through registration only cannot be a solution to such weakness, and that the selection of the marine-counsellor through an examination which is open to all and subsequent job training may be a way of a further improvement in the current marine-counsellor qualification and registration system.
