국문 초록

본 연구의 목적은 지방자치단체의 토지등록부서에 대한 명칭과 소속, 그리고 업무내용의 실태를 조사·분석하고, 이를 토대로 토지등록부서에 대한 명칭 변경의 필요성을 제기하는데 있다. 이를 위해 시간적 범위는 지적이라는 행정조직이 처음 설치된 1895년부터 현재까지로 하고, 공간적 범위는 한국으로 한정하며, 내용적 범위는 지방자치단체 토지등록부서의 명칭과 과 또는 국의 소속, 그리고 업무내용의 실태를 조사·분석하고, 이를 토대로 토지등록부서의 명칭 변경의 필요성을 제시하는 것이다. 이를 위한 조사방법은 문헌조사법과 인터넷조사법을 병행하였으며, 분석방법은 기술적 분석방법(記述的 分析方法)을 사용하였다. 연구 결과, 지방자치단체에서 토지등록업무를 담당하는 부서의 명칭이 매우 다양하고, 토지등록업무가 속하는 과 또는 국의 소속도 다양한 것으로 나타났다. 이로 인해 업무내용 또한 다양하게 이질적인 토지등록업무가 진행되고 있는 것으로 나타났다. 이상을 토대로 지방자치단체 토지등록부서의 명칭 변경의 필요성을 제기하면, 첫째, 토지등록부서 명칭과 업무내용이 일치되는 것이 민원의 편의성을 위한 길이며, 둘째, 토지등록담당부서의 과명 또는 국의 명칭에 따라 토지등록업무의 범위와 활동도 크게 제한받기 때문이며, 셋째, 지방자치단체별로도 동일한 토지등록업무를 담당하면서 각기 다른 부서와 명칭, 소속을 가지고 있어 국민들에게 큰 업무 혼선을 초래하고 있으며, 넷째, 토지등록업무는 통일성을 갖춰야 하는 국가사무이기 때문이다.

영문 초록

The purpose of this study is to propose a necessity of name change for land title registration departments in local governments based on survey and analysis of the current status of their names, affiliation, and tasks. To reach the goal, the methods employed to propose the necessity of name change of the land title registration departments are based on: setting the time period as between 1895, when the administrative organization for cadastral system was first established, and the present; restricting the spatial range to South Korea; establishing the scope of the content as survey and analysis of the current status of names, affiliation, and tasks of the land title registration departments of the local governments. Both of literature review and internet survey were applied together, and a descriptive analysis was implemented. The result reveals that not only the names of the departments in charge of land title registration in local governments but also their affiliations varies, which accordingly leads to disparate and diverse tasks for land title registration. The necessity and grounds to change the name of land title registration departments can be suggested as follows based on the result above. First, the convenience of civil affairs administration can be sought for by matching the title of the department and the task they deal with. Second, the scope and service of the land title registration can be largely restricted by the name of the land title registration department. Third, a huge confusion is brought about to citizens due to different names, departments, or affiliations given to the departments in charge of land title registration. Fourth, the land title registration is a national administrative work that requires unity.
