지적재조사측량 수반 국공유지의 합병에 관한 연구

국문 초록

우리나라 국공유지는 10,590,482필지 33,243㎢로 국토면적의 33.1%를 차지하고 있다. 대한민국헌법에서도 국공유지에 대한 국가와 지방자치단체의 책무가 정해져 있듯이 그간 중앙 및 지방정부에서 국공유지의 효율적인 관리를 위해 상당한 노력을 하였으나, 국공유지가 등록되어 있는 지적공부의 축척이 다르거나 서로 다른 유형의 지적도면에 등록되어 있는 경우에는 합병이 불가하여 국공유지관리의 큰 장애요인으로 작용하였다. 국공유지 관리의 주요한 장애요인을 해소하기 위한 방안으로 지적재조사측량을 수반하는 합병방법으로 실증한 결과, 행정적 측면에서 국공유지관리 대상 수가 현재 보다 85.7%가 감소하는 것으로 나타났으며, 경제적 측면에서 지적확정측량수수료의 95.9%, 지적일반측량수수료의 73.1%, 실태조사수수료의 93.3% 비용이 경감되는 것으로 확인되었으며, 법률적 측면에서는 공간정보관리법의 한계가 해소되는 것으로 나타났다. 국공유지의 표시를 새로이 구획하는 방식으로 합병되면 궁극적으로는 국공유지관리의 효율화에 기여할 수 있는 것으로 확인되었다.

영문 초록

Public Land of Korea is 33,243㎢ of 10,590,482 parcels, accounting for 33.1% of the land area. As the national and local governments responsibilities on public lands are determined in the Constitution of the Republic of Korea, the central and local governments have made considerable efforts to efficiently manage public lands, but if the scale of cadastral record is different or registered in different types of Cadastral Maps, the Annexation is not possible and acts as a major obstacle to the management of public lands. As a result of the Annexation method involving cadastral resurvey as a way to solve the main obstacles of public land management, the number of public land management subjects decreased by 85.7% from the present level in terms of administration. In terms of economy, 95.9% of cadastral confirmed survey fees, 73.1% of intellectual general survey fees, and 93.1% of precise survey fees were reduced. In terms of law, the limitations of the spatial information management law were resolved. Although the inefficiency of public land management was not improved because the scale of cadastral record was different or the scale of cadastral record was different only because it was different type of Cadastral Maps, if the Annexation was decided by newly dividing the indication of public land, it can ultimately contribute to the efficiency of public land management.
