스크린 골프의 저작권 침해 여부에 대한 연구

국문 초록

스크린 골프 서비스가 대중들이 쉽게 접근할 수 있게 되면서 고가의 비용을 요구하는 스포츠라는 이미지를 탈피하게 되고 새로운 레저 문화의 환경을 제공하게 되었다. 이러한 환경에도 불구하고 서울중앙지방법원 2015. 2.13. 선고, 2014가합520165 판결에서는 골프장은 연못이나 홀의 위치나 배치, 골프 코스가 돌아가는 흐름 등에 있어서 다른 골프장과 구분되는 창조적 개성이 있다고 판단하여 골프코스의 저작물성을 인정함과 동시에, 골프코스의 최초 운영업체들이 이러한 창조적 개성을 창작한 저작자라고 판결하였다. 그러나 이 판결은 골프코스가 저작물이라면 어떠한 저작물이고, 저작물이라면 합체의 원칙이나, 기능성의 원칙에 해당하여 보호받지 않는 아이디어로 판단할 수는 없는지에 대한 판단 없이 골프장의 최초 운영업체들이 업무상 저작물로서 골프장에 대한 저작권을 획득하는 것으로 판단하여 실제 골프장의 설계를 외부에 위탁하여 골프코스를 설계하고, 그러한 골프장 설계자가 저작자가 아니고, 골프장 운영업체가 저작자인지에 대한 객관적인 설명없이 객관적인 사실과 완전히 다르게 판단하였을 뿐만 아니라, 이렇게 저작자로서 골프장 운영업체를 인정한다고 하더라도 스크린 골프업체가 저작권법 제35조와 제35조의3에 근거하여 저작권침해가 되지 않을 수도 있는지의 여부를 판단하지 않고 저작권침해로 판시하였기에 본 논문에서는 판례에 대한 비판과 함께 고등법원에서 분석할 것이 무엇인지 설명하고자 한다.

영문 초록

As the price of indoor golf simulators becomes cheaper, many people have used and entertained the simulators as supplements to outdoor golf which needs much time, money. In other words, golf simulators have provided many people with new leisure culture. Under the changed environment, on February 13, 2015, Korean Seoul Central District Court held that, for the first time, golf courses are copyrightable due to authorship of golf courses (Case No. 2014 Gahap 520165). In this case, the court stated that “personality of a golf course may be shown location and arrangement of lakes, holes, and routing plan in golf courses after considering natural elements, such as topography, soil, direction of sunshine, wind, vegetation, and artificial elements, such as water approaching road, controlled road, supply, sewerage, electricity, and telecommunication.” and moreover, The court also stated that the author of the golf course is the first developers, not the planners who draw a blueprint of golf course. However, in this case, the court did not consider the merger doctrine, functionality of golf course. Moreover, the court did not consider section 35 and 35ter. Therefore, this writing delves into creativity of golf courses and limitation and exceptions of copyright about especially Articles 35 and 35ter of the Korean Copyright Act. In this article, I argue that the gold course is not copyrighted due to its functionality, and even though it may be copyrightable, its author is the designer of the golf course plan. In addition, the golf simulators is not copyright infringement under Articles 35 (2) and 35 ter of the Korean Copyright Act.
