국문 초록

과거 한국은 폐허로부터 산업을 부흥시키기 위해 개인 소유의 토지에 대해 도시계획시설 용도로 지정하여 개인의 재산권을 침해해왔다. 그러나 “국토의 계획 및 이용에 관한 법률“에 따라서 도시계획시설의 실효성이 상실되는 2020년 7월1일 이후에는 장기 미집행 도시계획시설에 대한 개인들의 권리를 되찾기 위한 각종 민원이 봇물이 터지듯이 발생 될 가능성이 제기되고 있다. 이에 따라 정부나 지방자치단체에서는 이 기한일이 도래되기 전에 집행이 되지 않았던 많은 토지나 건물에 대한 집행이 예상되고 있다. 그동안 국가의 발전 및 공익을 위하여 희생을 감수하여 왔던 개인의 재산권을 되찾기 위한 행사를 할 수 있는 기일이 다가옴에 따라서 국가의 발전을 위하여 묶여왔던 많은 시설들이 동시에 해제가 된다. 따라서 정부는 장기미집행시설 중 꼭 필요한 곳만을 정하여 재지정을 할 수 있는 법안을 조속히 입법을 하던지, 아니면 정부가 나서서 매수청구권을 행사하여야 하는 상황에 처하게 되었다. 그럼에도 불구하고 전자는 국민의 기본적 재산권을 침해할 소지가 매우 크고, 후자는 정부가 그 비용을 모두 감당하기에는 턱없이 부족한 예산으로 3년 내에 해결책을 찾아서 집행을 해야 한다는 것이 큰 부담으로 작용을 하고 있다. 따라서 본 보고서에서는 장기미집행시설과 관련 제도 및 실태를 점검하고 국내ㆍ외 사례를 통해 문화콘텐츠를 기반으로 한 유휴지 및 장기미집행 도시ㆍ군 계획시설의 지속성장 가능한 활용 방안에 대하여 논의하고자 한다.

영문 초록

As a means to revitalize the industry from the devastated Korea in the past, the government has decided to designate the use of urban planning facilities from the individuals who owned the land and a lot of land has not been developed yet. Upon July 1, 2020, the right of individuals to the long-term unplanned city planning facilities may become legally possible to reclaim. And the government may become a subject to be claimed or has to re-designate the properties to the same again or extend the use of urban planning facilities. Therefore, the government or municipalities are expected to enforce many land or buildings that were not enforced before the due date. In the meantime, due to the time for the event to recover the property rights of the individuals who have been sacrificing for the development of the nation and the public interest, many real estate that have been tied up for the development of the country have been lifted at the same time, The government was either forced to legislate the bill to redirect itself or to exercise the right to buy it. Nevertheless, the former is highly likely to infringe the basic property rights of the people, and the latter is a burden to the government to find and implement a solution within three years with a budget that is too short to cover the costs. Therefore, it is the best way for the government or municipal government to execute necessary facilities that have been planned yet not been implemented in the meantime. That is, selection and concentration became more urgent than ever. Therefore, in this research, we will examine the related systems and actual conditions of urban and regional planning facilities, and discuss how to utilize unused spaces and long-term undeveloped urban and regional planning facilities through cultural contents based on domestic and foreign cases.
