국문 초록

5･18항쟁은 한국 민주화운동의 원동력이라 할 수 있다. 5･18항쟁이 있었기에 1987년6월항쟁이 유혈사태를 수반하지 않은 민주화이행으로 이어질 수 있었다. 지난 1년 동안 활동해온 국회개헌특위자문위원회 최종보고서에는 기존의 4･19와 함께 새롭게 6･ 10항쟁을 헌법 전문에 담고 있다. 하지만, 문재인 대통령까지 공약하고 있는 5･18정신을 최종보고서의 헌법 전문 시안에 반영하지 않은 것은 5･18항쟁이 지역적 한계를 지니며, 역사적 평가가 이루어지지 않았다는 편협한 견해에 터를 잡고 있다. 그러나 5･18항쟁은 이미 대법원으로부터 1997년 판결을 통해 국헌문란세력에 항의하여 헌정질서를 수호하기 위한 정당한 행위였다는 역사적인 평가를 받았다. 뿐만 아니라, 정부는 1997년에 항쟁이 시작된 5월 18일을 국가기념일로 지정하였으며, 2002년에는 법률을 제정하여 5･18항쟁과 관련하여 희생하거나 공헌한 자들을 5･18민주유공자로 예우하고 있다. 나아가 5･18의 지역적 한계성에 대한 지적은 5･18항쟁이 79년 10･26이후 봇물처럼 일어난 민주화운동의 연속선상에서 일어난 것이지 광주만의 어떤 특수문제를 내걸고 광주지역에 한정해서 일어난 것이 아니기 때문에 현상적으로만 평가해서는 안된다. 5･18항쟁이 전국적으로 확산되지 못한 것은 신군부세력이 12･12로 군권을 장악한 후‘K-공작계획’ 등을 세워 정권장악을 위한 치밀한 준비를 하고 전국비상계엄확대를 선포하기 직전에 시위 주동자급 학생들과 거물급 정치인들을 대대적으로 예비검속하고 주요 대학 캠퍼스에 군부대를 배치하였으며, 광주의 외곽지역을 공수부대를 비롯한 계엄군들이 철저하게 차단하였을 뿐만 아니라, 언론과 통신, 전화선까지 차단하여 시위의전국 확산을 철저하게 저지하였기 때문이다. 본 논문에서는 국가권력의 폭력적 지배에 맞서 국민의 자유와 권리를 수호하고, 헌정질서를 회복･유지하기 위한 정당한 행위로서 ‘민주주의’와 ‘저항’의 헌법적 가치를 지니고, 근대시민혁명을 경험하지 못한 우리 헌정사에서 이른바 ‘주권혁명’이라는 헌정사적의미를 지닌 5･18항쟁의 정신이 반드시 헌법 전문에 반영되어야 하는 헌법적 당위성을제기하고자 한다.

영문 초록

The May 18th Democratic Uprising(the “5.18 Uprising) has been the driving force for Korea’s movement toward democracy. By virtue of 5.18 Uprising and the 1987 June Democracy Movement eventually made it possible for Korea to have a transition to democracy without any bloody situation. Advisory Committee on the Special Committee on the Constitution’s final report during the last year had included 6.10 Movement in addition to the 4.19 revolution in the preamble to the constitution. Even President Moon Jae-in had pledged an inclusion of 5.18 spirit into the preamble to the constitution, but it unfortunately did not happen. The reasons or this failure included regional limitation and the lack of a local outlook of historical assessment. However, the 5.18 Uprising had historical assessment by the supreme court with 1997’s judgement that it was a justifiable civic movement for depending the constitutional orders and values. Furthermore, in 1997, the Korean government made the day of May 18th an official national holiday. In 2002, an enactment of a new Act honored people who related to 5.18 Uprising persons of national merit. Also, 5.18’s regional limitations pointed out that the unleash of a pro-democracy movement after 1979’s 10.26. As such, 5.18 can’t be evaluated with Gwangju region’s limited subject The reason why 5.18 Uprising couldn’t spread to the whole country was because of the military influence as a result of the 12.12 military coup. Their ‘K-Operation plan’ for the seizure of power that right before the emergency martial law, preventive custody was imposed upon active students of demonstration and major politicians. They placed army to universities, and blocked Gwangju not only areal but also journal, communication and phone line. This paper urges the Constitution to reflect the 5.18 spirit in the preamble to the constitution with meaning of ‘sovereignty revolution’ which our history never experienced with the name of modern civil revolution. 5.18 Uprising has the constitutional value of ‘democracy’ and ‘resistance’ in that it was right action to maintain and recover the constitutional order with protecting civil freedom and rights against violent dictatorship of government power.
