국문 초록

과학기술의 발달로 인하여 우리의 생활과 환경에 많은 변화를 가져왔다. 특히, 의학기술의 발달로 과거에 비하여 평균수명이 증가되어, 고령화 사회로 진입하게 되었다. 특히, 우리나라의 노인 인구 비율이 고령화 사회에서 고령사회로 진입하는데 불과 27년밖에 안 걸렸으며, 고령화 속도는 세계에서 가장 빠르게 진행되고 있다. 이에 ‘2004년 고령화 및 미래 사회 위원회’창설을 기점으로 본격적으로 노인 문제에 대하여 정부가 접근하기 시작하였으며, 다양한 복지 정책을 제시하고 있다. 하지만 빠른 고령화 진행 속도에 비해 아무런 준비 없이 노후를 맞이하게 되는 노인이 증가함으로써 경제적⋅사회적 위축으로 인한 생계형 노인 범죄자가 지속적으로 증가하고 있으며 노인 범죄자의 재범률 또한 증가하고 있다. 이에 증가하고 있는 생계형 노인 범죄자의 발생 및 재범을 예방하기 위한 종합적인 대책 방안의 모색이 필요하다. 본 연구에서는 노인 범죄 및 재범을 예방하고 더 나아가 노인의 재사회화를 강화시키기 위한 방안으로 노인 형법 범죄의 실태를 살펴보고 노인 범죄의 근본적인 원인을 아노미 이론과 발전 범죄학에 근거하여 살펴보고 대책을 제시하였다. 노인 범죄 및 재범 예방을 위한 대책으로 은퇴, 이혼 등으로 인한 사회적 유대관계의 단절을 예방하기 위하여 노인의 사회적 유대관계 강화를 위한 지역사회 네트워크 확립의 필요성을 제시하였다. 또한 노인의 경제적 빈곤을 예방하기 위한 노인 일자리 지원 강화를 제시하였으며, 노인 스스로 자신의 문제에 적극적으로 대처할 수 있는 능력을 향상시키기 위한 노인 전담 기관 및 교육 프로그램 마련을 제시하였다. 또한 범죄 경력의 중단을 위한 재범 예방 교육 프로그램 개발 방안에 대해서도 제안하였다.

영문 초록

The development of science and technology has brought about a lot of changes in our lives and the environment. In particular, the development of medical technology has increased the average life expectancy compared to the past, entering into an aging society. It only took twenty-seven years for Korea to enter into the aged society from an aging society, and the rate of aging is the fastest in the world. The government has started to tackle this issue of the elderly with the establishment of the ‘2004 Aging and Future Society Committee’, presenting a range of welfare policies. However, the number of the elderly who are aging without any preparation is increasing in comparison to the rapid rate of aging, and the number of subsistence criminals has been continuously increasing due to economic and social intimidation, and the recidivism rate of elderly criminals is also increasing. Therefore, there is an urgent need for comprehensive countermeasures to prevent the occurrence and recidivism of elderly subsistence criminals. This study has examined the reality of criminal offenses of the elderly as a way to prevent elderly crime and recidivism and to reinforce the re-socialization of the elderly, and examined the fundamental cause of elderly crime based on the anomie theory. It also examined the causes of elderly crime desistance based on developmental criminology to prevent elderly recidivism, and proposed relevant countermeasures. As a countermeasure against elderly crime and recidivism, this study proposed the necessity of establishing a community network to strengthen the social relationships of the elderly to prevent the interruption of social relationships caused by retirement and divorce. Moreover, strengthened job support for senior citizens to prevent economic poverty for the elderly. The study also proposed the establishment of dedicated institutions and education programs for the elderly to improve the ability of the elderly to actively cope with their problems. Lastly, suggestions were made for the development of recidivism prevention education programs to stop criminal history.
