국문 초록

오늘날 국제사회는 정치적 이념, 인종, 종교, 사회문제 등 다양한 이유로 갈등이 고조되고 있으며, 불특정 다수에 대한 무차별적 테러범죄를 비롯한 초국가적 안보를 위협하는 범죄가 발생하는 등 새로운 유형의 안보위협 환경에 직면해 있다. 이러한 초국가적 안보위해범죄에 대응하기 위하여 주요 안보선진국가에서는 형사사법 특례절차를 마련하는데 최선을 다하고 있는 실정이다. 특히, 국가안보사범의 은밀한 범행수단과 행태는 정보ㆍ수사기관의 적발과 탐지의 어려움으로 인해 발생건수의 희소성으로 이어지며, 범죄의 유죄를 입증 및 처벌하기에 충분한 증거가 항상 부족하기 때문에 증거수집 활동의 어려움과 상당한 제약이 따른다. 반면, 국내의 경우 국가안보 위해사건에 대한 대응 법제가 미비하여 일반 형사법 체계 하에서 일반 범죄자와 동일한 방법으로 증거수집 및 범죄수사가 진행되며, 그 요건이나 절차에 있어서도 사법부는 일반 형사범죄와 동일하게 요건을 요구하고 예외적 상황을 고려하는데 인색한 실정이다. 결국, 초국가적 안보위해범죄는 일반형사범죄와는 다른 영역에서 활동하기 때문에 사전적 정보활동이 중요하며, 국내ㆍ외의 정보공동체의 역할이 중요하게 작용하고 있다.

영문 초록

Today, the world is at odds with conflict for a variety of reasons, including political ideology, religion, race and nationality. The security environment threatens transnational security, including indiscriminate terrorism against unspecified majority. In order to respond to new forms of transnational security crimes, the world is doing its best to prepare special procedures for criminal justice agencies. In particular, intelligence and investigation agencies are difficult to crack down and detect due to the secret means and methods of criminal offenses, and always lack sufficient evidence to prove and punish the guilt of crimes. As a result, the difficulties of collecting evidence from intelligence and investigative agencies and significant limitations. On the other hand, in Korea, evidence collection and criminal investigations proceed under the general criminal law system due to the lack of legislation in response to national security crime. In addition, the judiciary requires the same requirements for criminal offenses as for ordinary criminal offenses. After all, transnational security crimes operate in the area of general criminal offenses, so prior intelligence activities are important, and the role of intelligence community is important.
