대학입학사정에 관한 법적 고찰: 그 위법사유와 권리구제를 중심으로

국문 초록

연구는 대학입학사정의 의의와 법적 성질을 검토하고, 대학입학사정에서 발생할 수 있는 위법사유와 그에 대한 지원자들의 권리구제 절차를 고찰한 후, 대학 등이 입학 전형에서 유의해야 할 사항을 도출하는데 목적이 있다 본 연구내용을 통해 도출한 연구 결과는 다음과 같다. 대학은 입학사정을 함에 있어서, 대학은 대학입학전형시행계획 또는 입학사정기준 등을 구체적이고 명확하게 정하여 입학사정의 투명성과 신뢰성을 확보하고 이를 엄수하여야 한다. 그리고 대입전형자료를 조사 및 심사하여 입학여부를 결정하는 입학사정관의 전문성과 공정성을 향상하여야 한다. 특히 입학사정관은 그 행위가 위법이 되는 사유를 정확하게 인지하고 입학사정의 공정성과 객관성을 확보함과 아울러 입학사정을 둘러싼 분쟁을 예방하여야 한다. 대학은 사정단계별로 일정한 절차를 정하여야 하고, 지원자에게 불리한 처분을 할 경우 청문, 의견진술, 자료 보완의 기회를 부여하여야 한다. 가장 중요한 것은 신뢰보호의 원칙을 준수하여야 한다. 지원자는 이미 공표된 입학전형계획이나 입시요강 등이 장래에 지속될 것이라고 합리적으로 신뢰하고 그것을 바탕으로 입학전형을 준비하여 왔기 때문에 대학이 이와 같은 지원자익 신뢰를 되도록 보호하여야 한다.

영문 초록

After examining the significance and legal characteristics of college admissions and investigating the cause of illegality and applicants` disobedience procedure against it, the study is to extract some factors that colleges should keep in mind in admission screening. The main results of the study as the follows. First, colleges should concretely and specifically establish and keep college admission screening administration plan or admissions office criteria for getting clarity and reliability. Second, the specialty and fairness of admissions officer who decide admission examining and assessing college screening materials should be improved. Especially, by knowing exactly the cause that a special action becomes a illegality, the admissions officer should get fairness and objectivity and prevent some disputes in admissions office. Third, colleges should make regular procedure by step. And if they give some disadvantageous measures to applicants, they should present some opportunities for audition, opinion statements, and materials supplementation. Most important thing is that the principle of the prevention of reliability should be kept. Because applicants have prepared admission screening based on beliefs that admission screening plan or college entrance requirement list announced already will continued in the future, the reliability of the applicants should be protected by colleges.
