사립학교법에 대한 입법 개선 방향과 사학육성특별법 제정 방안에 관한 연구

국문 초록

이 논문은 현행 사립학교법익 문제점에 비추어 학술적으로 바람직한 사립학교법익 입법 개선 방향을 제시하고, 이에 근거하여 사학육성특별법이라고 하는 제정법안을 제안하기 위한 목적으로 사도되었다. 이를 위해 현행 사립학교법익 개선 방향 4가지로서, 사립학교법 폐지와 대체입법으로서 사학육성법의 제정, 사립학교법 폐지와 초·중등교육 법과 고등교육법 등 관련법의 개정을 통한 보완, 사립학교법 폐지와 3개의 학교법인법·사학교원에관한법률·사학육성법으로 분리 제정하는 방안, 사립학교법 개정과 보완입법으로서 사학육성특별법의 제정 방안을 제시하고 이 중에서 네 번째 방안을 현실적인 방안으로 보고 사학육성특별법(안)을 구체적으로 제안하였다. 사학육성특별법(안)은 사립학교 표준교육비 총액의 2분의 1과 사립대학 경상비 총액의 2분의 1을 기준으로 한 지원, 사립학교 및 사립대학 육성위원회 설치, 우수사립대학에 대한 평가와 지원, 사학 기부금에 대한 세법상 우대조치, 국제화지원 및 실업교육 배려 등을 주된 내용으로 하고 있다. 사학육성특별법 제정에 따른 기대효과로서 대학경쟁력 및 국가경쟁력 강화, 대학 등록금 경감 및 연상 억제, 비정규직 교원 대우 향상, 소득재분배 효과, OECD 평균 수 준익 교육예산 확보 등을 들 수 있다.

영문 초록

The Purpose of this study is to suggest the improvement direction of the Korean Private School Law and the legislation of `the Private School Support Act`. For the improvement of the Korean Private School Law can be four directions: abolition of the Private School Law and the legislation of the Private School Support Act, abolition of the Private School Law and amendment of the First- Secondary Education Law and Higher Education Law, abolition of the Private School Law and legislation of Private School Corporation Act/Private School Teacher Act/Private School Support Act, amendment of the Private School Law and legislation of the Private School Support Act. The fourth direction is here suggested. The suggested Private School Support Act includes the financial Aids of the government to the private schools and universities, the foundation of the Private School and University Committee, the assessment and the support of the best Private Universities, tax affirmative to the private donations, support to the globalization of private schools and universities, support to the Trade and Industry Education in private schools and universities. Expectations from the legislation of `the Private School Support Act` are competition strengthening of the university and nation, reduction of education fee, pay improvement of irregular teacher and lecturer, new distribution effect of income etc.
