교원소청심사위원회의 결정 경향에 관한 연구

국문 초록

본 논문은 교원소청삼사위원회가 설립된 이후 그동안 내려온 징계처분 관련 결정들의 경향을 연구·분석하는데 목적이 있다. 연구 내용은 교원소청심사위원회의 관장 사무와 결정 효력, 그리고 2005년 동 기관이 설립된 이후 현재까지 동 위원회의 다양한 결정 경향들을 직위별, 설립별, 학교급별, 징계사유별로 분석하였다. 연구방법은 교원소청 심사위원회의 결정문을 중심으로 한 문헌분석 방법을 주로 사용하였다. 연구결과 첫째, 전체 174건 중 기각률이 74건(42.5%)으로 가장 높은 비중을 차지하고 있으며, 둘째, 시국과 관련된 사건은 엄격한 잣대를 들이 대는데 비해(감경비율 0%) 여타의 사건들은 정계당사자의 그동안 공적을 참작하여 감경해 주는 경향이 있고, 셋째, 초·중등 교원(25.5%)보다는 대학 교원들(56.6%)에게 징계 또는 불리한 처분들을 완화해 주는 경향이 있으며, 넷째, 사립학교 교원은 징계절차상의 하자, 징계양정의 과다 등으로 인해 취소 또는 감경되는 비율(59.5%)이 국공립의 교원의 비율(22.1%)보다 두 배 이상 높음을 발견하였다. 결론으로는 교원소청심사위원회의 발전을 위해 네 가지의 정책제안을 제시하였다.

영문 초록

The purpose of this study was to analyse the decision tendency of Appeal Commission For Teachers. Study contents are business affairs, decision effects and diverse decision tendency of Appeal Commission For Teachers. Especially decision tendency was analysed by the position of teachers and professors, institution`s style of schools, the level of schools, the cause of disciplinary punishment. Study method was based on literature research. Study results are 4. 1st, rejection rate is highest as 42.5%(N=74) among 174 cases. 2nd, current situation related cases was governed very strictly(reducing rate is 0%), but the other`s cases had a reduction tendency. 3rd, cancellation rate or reduction rate of professors(56.6%) was higher than that of teachers who work at elementary, middle, and high schools(25.5%). 4th, cancellation rate or reduction rate of private schools` teachers (59.5%) was higher than that of national and municipal schools` teachers(22.1%). It was due to a flaw of dismissal process and extreme disciplinary punishment. As a conclusion, researcher proposed four policy proposition for development of Appeal Commission For Teachers. 1st, committee member of the Appeal Commission For Teachers should be increased to raise the equity of decision as a more than two representatives of Teachers` Organization. 2nd, the disciplinary committee of metropolitan city or province is consisted of educational officers. To increase the equity of an inquiry commission, representatives of parents or civilians should be associated with the committee. 3rd, punishment standard of a sexual violence to the young people should be enforced as a disciplinary punishment. 4th, For guaranteing people` legal rights and research, data of Appeal Commission For Teachers should be used except a person`s private matter.
