북한정권 수립 70년과 북한 헌법의 변화와 전망

국문 초록

2018년 대한민국 정부수립 70주년은 북한의 입장에서는 공화국 창건 70년을 의미한다. 70년의 북한의 헌법의 내용과 변화를 살피는 것은 북한정권의 역사와 특징을 파악하는 데에 큰 도움이 된다. 북한의 정치체제는 한마디로 ‘수령의 유일지배체제’라는 특성을 가지고 있다. 이 체제는 김일성과 김정일에 이어 김정은으로 권력이 승계되어 더욱 공고한 상태를 유지하고 있다. 1945년 일제로부터의 광복 이후 한반도는 대외내적 상황에 의해 남북으로 분단되었고 통일을 이루기 위한 부단한 노력이 이어졌지만 여전히 분단국가로 남아 있다. 광복 직후 한반도의 북위 38도선을 기준으로 남북 지역에서 소련과 미국의 군정을 거친 후, 남쪽 지역에는 ‘대한민국’을 수립하고(1948. 8. 15), 북쪽 지역에는 ‘조선민주주의인민공화국’을 국호로 하는 정권이 수립되었다(1948. 9. 9). 남북한은 각기 정부(정권)를 수립하면서 국가와 정부의 기본법으로서 각각의 헌법을 제정하였다. 북한법에 대한 의미와 효력면에서 부정적인 평가가 있지만, 북한 헌법은 정권의 이념과 체제의 기본원칙과 질서를 담고 있음을 알 수 있다. 김일성 주석, 김정일 국방위원장, 김정은 국무위원장은 북한 헌법상 권력체제의 정점에 있는 직위이며, 이를 헌법적으로 제도화하고 있다. 기실 북한도 헌법을 국내법의 최상위법으로 정의하고 있으며, 헌법에서 조선민주주의인민공화국의 정치, 경제, 문화, 국방, 기본권, 국가기관체계 등의 원리와 체계 등을 규율하고 있다. 북한헌법은 역사적으로 북한 정권의 변화과정을 담고 있으며, 통치조직의 원리와 체계를 규정하고 북한 정권의 발전 토대와 방향을 설정해오고 있다. 따라서 북한 헌법의 역사와 개념, 그리고 주요 변화내용을 고찰하는 것은 형식상 가장 객관적인 법규범을 통해 북한을 이해하는 방법이라 할 수 있다. 이 연구는 북한의 사회주의헌법의 변천을 중심으로 그 원리와 체계, 그리고 내용과 특징을 고찰한다. 그 가운데 사회주의 헌법상 경제조항을 중심으로 논급하고 그 변화의 가능성도 검토해본다. 북한정권이 김일성, 김정일, 김정은의 3대를 세습하여 지속된 일 인지도체제를 기반으로 발전해 온 과정에서 나타난 헌법의 특징을 살펴본다. 특히 이 논의는 결과적으로 현실의 북한 김정은정권을 중심으로 헌법의 특징을 살피고 전망하는 데에 목적을 두어 논급한다.

영문 초록

Criminal law is an important norm that maintains the basic order of society and guarantees individual rights. North Korea also has criminal laws that are represented by Criminal Code of North Korea( NKCC ) and Criminal Procedure Act of North Korea( NKCPA ). Thecriminal laws in North Korea plays an important role in maintaining the order of socialism as a means of realizing the Proletarian dictatorship. The NKCC is being revised very often because it is the only substantive criminal law existing in North Korea. In other words, if the North Korea needs to maintain its regime and change its social environment, or if it needs to adjust the level of punishment, the NKCC is amended. Through this, we can see the changes in social life that are taking place in North Korean society. NKCC has recently been revised the most in economic activities. In the past, the focus was shifted from political criminal law to economic criminal law. It is desirable that the principle of legality is strengthened and the regulations are more specific, but the class nature of the North Korean criminal law remains the same. NKCPA has also been revised several times to make the regulations more systematic and more advanced in terms of human rights security. The arrest warrant system is introduced, the period of arrest is limited, and statements by coercion or judo are not available as evidence, and the rules for reinforcing a confession are also stipulated. However, the essential nature of the Criminal Procedure Act remains the same, and many irrational problems are maintained. Above all, the NKCPA does not introduce the principle of warrant requirement by judges, lack of human rights, insufficient guarantee of the right to counsel, and insufficient guarantee of judicial independence. North Korea s criminal laws are expected to be revised frequently in the future. It is expected that the system will take a step closer to ensuring human rights that conform to international standards, thereby strengthening the implementation of rule of law and the protection of human rights under criminal law.
