국문 초록

연구목적은 법적 지위 및 지원 대상의 개념과 범주를 명확하게 하는 것이다. 궁극적으로 북한이탈주민의 보호 및 정착지원을 내실화하는 데 기여하려고 한다. 탈북청소년은 북한이탈주민인가? 법률에서 ‘탈북 청소년’은 북한이탈주민이지만, 정책에서 ‘탈북청소년’은 북한이탈주민이 아닐 수도 있다. ‘탈북청소년’이 북한이탈주민의 자녀로서 ‘제3국 출생 청소년’을 포함할 수 있기 때문이다. ‘제3국 출생’을 포괄할 수 있는 개념이 필요하다. 법적 지위 및 지원 대상에서 ‘제3국 출생’을 포괄할 수 있는 개념은 무엇인가? ‘북한 이탈주민 가정’ 또는 ‘탈북가정’이 ‘제3국 출생’을 포괄하는 개념이 될 수 있다. 교육지 원 조례에서 ‘탈북가정청소년’은 ‘북한이탈주민의 자녀’로서 ‘탈북청소년’과 ‘제3국 출생 청소년’을 포괄하고 있다. ‘탈북가정’을 ‘제3국 출생’을 포괄하는 개념으로 활용함으로써, 법적 지위 및 지원 대상의 개념을 명확하게 하고 범주의 불일치 문제를 해소할 수 있다. 기존 연구에서 언급 하는 보호 및 지원의 확대를 논할 수 있는 시점이 마련된 것이라고 할 수 있다.

영문 초록

The purpose of this study is to clarify the concepts and categories of the legal status and whom to support. It can ultimately contribute to the improvement of protection and settlement support for North Korean defectors. Are “North Korean defector youths” North Korean defectors? “North Korean defector youths” are North Korean defectors in act. However, they might not be North Korean defectors in policies. It is because “North Korean defector youths” can include youths born in third countries as North Korean defectors’ children. We need a concept that can include “birth in third countries.” What is the concept that can include “birth in third countries”? “North Korean defector family” can be the concept that includes “birth in third countries.” “Youths of North Korean defector family” in educational support ordinances include both “North Korean defector youths” and youths born in third countries as North Korean defectors’ children. Using “North Korean defector family” as a concept including “birth in third countries” can clarify the concept of legal status and whom to support. It can also solve the problem of discrepancies in their categories. It can be said to be the point at which we can discuss the expansion of protection and settlement support mentioned in previous studies.
