조중우호협조 및 호상원조조약에 대한 고찰

국문 초록

한국의 사드배치로 인한 한중갈등, 미국 트럼프정부의 북한 선제공격설이 우세하더니 최근 남ㆍ북ㆍ미 대화에 대한 기대로 한반도에 훈풍이 불고 있다. 하지만 북미대화의 결과에 따라 미국의 선제공격이 대두될 수 있다는 점에서 한반도의 정세는 안정적이지만은 않다. 이러한 시대적 배경을 바탕으로 본 연구는 중국과 북한 간 체결한 “조중우호협력 및 호상원조 조약”(이하 조중우호조약)의 내용을 분석하고 한반도 안보의 불확실성을 상쇄시키기 위해 조약 상 중국의 역할을 제고하려 하였다. 조중우호조약의 제2조에 따른 자동개입조항은 국제관습법상 자위권의 행사에 따라 필요성과 비례성 요건을 충족해야 하며, 절차상으로는 UN헌장 제51조에 따라 UN안전보장이사회가 필요한 조치를 취하기 전까지만 자위권을 행사해야 한다. 한반도 유사 시 조중우호조약에 따른 중국의 개입은 UN헌장 제48조와 제103조에 따라 한계를 가진다. 체제이행기 후 조중우호조약의 승계는 조중우호조약이 북한과 중국 간 역사적 배경을 바탕으로 체결된 특수한 조약이고 현재 중국은 비동맹외교노선을 채택하고 있다는 점에서 향후 위 조약이 승계될 여지는 없어 보인다.

영문 초록

The ROK-China conflicts due to THAAD deployment in South Korea and the U.S. Trump administration’s preemptive strike doctrine toward the DPRK have put the security of the Korean Peninsula in a grave state. At the same time, positive expectations for ROK-DPRK-U.S. talks have been growing recently. However, since whether the U.S. will conduct a preemptive strike or not depends on the results of the U.S.-DPRK talks, the security of the Korean Peninsula is in a precarious state. This paper, therefore, attempts to analyze the Sino-North Korean Mutual Aid and Cooperation Friendship Treaty (hereon referred to as the Sino-North Korean Friendship Treaty) that will allow for reconsideration of China’s role in nullifying the uncertainty on the Korean Peninsula according to the treaty. The Automatic intervention, according to Article 2 of the Sino-North Korean Friendship Treaty, is an exercise of the right of self-defense that can be implemented when the requirements of necessity and proportionality of Customary International Law are met, and only until the UN Security council takes appropriate measures, according to Article 51 of the UN Charter. China’s intervention in case of contingency on the Korean Peninsula, according to the Sino-North Korean Friendship Treaty, has limitations in compliance with Articles 48 and 103 of the UN Charter. It is a special treaty based on the historical background between North Korea and China. Also, since recent China has adopted ‘non-alignment’ as a foreign policy, it is unlikely that the Sino-North Korean Friendship Treaty will be succeeded after the regime transition.
