국문 초록

북한헌법의 기본권 조항의 변화는 1948년 인민민주주의 헌법시대를 거쳐, 1972년 사회주의헌법 체제로의 변화 그리고 2012년 김일성-김정일 헌법까지 기본권 분야의 헌법사적인 영역을 의미한다. 북한헌법의 공민의 인권관련 조항은 헌법 제5장에 규정 되어 있다. 국가 보다 당 우위의 북한사회에서 헌법을 비롯한 각종 법령 등 국가내의 공식 규범체계는 당의 지침이나, 민주적 중앙집중에 따른 이른바 김일성, 김정일, 김정은의 교시와 말씀 등이 헌법을 초월 하여 존재한다. 이는 북한헌법에 규정된 공민의 기본권리가 국가로 부터의 자유라기보다는 사회주의혁명 완수를 위한 집단적, 사회적 인간을 상정한 권리이며, 권리의 보장 보다는 정치사상적 통일을 위한 마땅히 수행해야할 권리라고 할 수 있다. 즉, 표현할 수 있는 권리가 아닌 표현해야 할 의무라고 할 것이다. 북한 기본권의 특징은 권리와 의무가 동시에 이뤄지는 것인데, 그 형태는 사회주의혁명 완수와 기본권의 집단주의 원칙 하 에서의 단결, 주체사상에 입각한 정치사상의 통일, 조국보위의무와 항상 결부 되어 나타난다. 북한의 헌법이 근로인민대중의 이익을 위하여 인민들 자신이 만든 국가관리의 기본법이므로, 자신 스스로 만든 헌법과 법령은 인민의 의사와 처음부터 다를 수가 없고, 인민의 의사는 당과 수령의 의사와 일치 하는 고로 당과 국가, 그리고 인민의 의사는 항상 일치해야 하는 구조 에서 출발한다. 따라서 이들 상호간의 간극은 논리적으로 성립 하지 않게 된다. 이러한 북한 헌법의 기본권은 매우 독창적이며, 실재 적용면에서는 장식적이고, 명목에 그치는 선언적 권리의 나열이라 할 수 있으며, 공민의 의무는 선정적이고, 집단주의 원칙에 따른 과도한 충성요구이다. 이는 천부적 권리 또는 자연권적 성질의 기본권이 아닌 계급과 집단 이익에 기초한 기본권이라고 할 수 있다.

영문 초록

The changes in the provisions of basic rights of the North Korean Constitution refer to the constitutional historical domain of basic rights, ranging from the Constitution of the People’s Democratic Constitution of 1948, the transition to the socialist constitutional system of 1972, and the Constitution of Kim Il-sung & Kim Jong-il in 2012. The North Korean constitutional provisions on human rights are stipulated in Chapter 5 of the North Korean Constitution. However, the formal normative system in the country, such as the Constitution and various laws and regulations in the North Korean society, where the party is superior to the state, cannot be applied to the guidelines of the Party or the so-called instructions and words of Kim Il-sung, Kim Jong-il and Kim Jong-un according to the democratic centralized system, which exist beyond the Constitution. The basic rights of the citizens prescribed in the North Korean Constitution are not the freedom from the state but the right to assume the collective and social human beings for the fulfillment of the socialist revolution and as a duty for the unification of political thought rather than rights. In other words, it is more like a duty to express than a right to express. The characteristics of North Korea’s basic rights consist of rights and duties at the same time, and the forms are always associated with the fulfillment of the socialist revolution and unity under the principle of collectivism of basic rights, the unification of political ideas based on the Juche idea, and the duty of national security. Since the Constitution of North Korea is the foundation of the people’s own management for the benefit of the working people, the Constitution and the laws made by them cannot be different from the opinions of the people. The opinions of the party, the state and the people always start from a structure that can always be reconciled. Therefore, the gap between these three is not logically to be established. The fundamental rights of the North Korean Constitution are very original and are a list of decorative and nominal declarative rights in terms of application of reality, citizens’ duty is sensational, and excessive loyalty is demanded by collectivist principles. Therefore, it can be said that it is a basic right based on the interests of class and group, not basic rights of natural rights or fundamental rights.
