국문 초록

오늘날 현대적 기본권은 ‘주관적 공권성’과 ‘객관적 규범성’이 모두 규율되어 있다. 북한에서도 기본권으로서 노동권의 개념과 관련하여 직업을 자유로이 선택할 수 있는 권리, 안정된 직업을 보장받을 수 있는 권리, 일한 것만큼 보수를 받을 수 있는 권리 등의 개념으로 논하고 있다. 그러면서 노동의 권리와 의무는 서로 불가분의 관계로서, 노동에 대한 의무의 실현과정은 곧 권리의 실현과정으로 된다고 한다. 즉, 노동에 대한 권리와 의무의 어느 하나만을 인정하거나 다른 어느 하나를 부여하지 않는 경우, 근로자들은 일자리와 노동 및 생활조건을 확고히 보장받을 수 없으며 노동생활에서 주인으로서의 본분을 다할 수 없기 때문이라는 것이다. 그래서 노동의 의무에 대한 법적 규제를 중요시한다는 것을 강조한다. 이처럼 북한에서 노동권은 국가가 주체가 되어 공민에게 직접 근로의 권리와 의무를 하나로 연결하여 강제하는 모순적인 규범성을 갖고 있다. 결과적으로 북한에서 노동권의 규범원리는 ‘노동의 의무’를 정당화하는 것에 집중되어 있는 것으로 볼 수 있다.

영문 초록

In this era, modern fundamental rights has all the Subjective public right and Objective Normative. North Korea also discusses the concept of labor rights as a basic right. It has freedom of choice a profession, right to a guaranteed of stable job, right to receive remuneration. However, if is argued that the rights and obligations of workers shall be inseparable from each other. That’s insists that the process of realizing the duty of labor is soon to be the realization process of rights. In other words, it should not be allowed to recognize either one of the rights and obligations of labor or grant another one. Workers Interpret that their jobs and living conditions can not be guaranteed and that they can not fulfill their duties as masters in labor life. Also, because I can not fulfill my duty as a master in labor life. Therefore, it emphasizes the legal regulations on the duty of labor. In this way, labor rights in North Korea have a contradictory norm that the state becomes a subject and forces and connects rights and duty. As a result, the norms of labor rights in North Korea are focused on justifying the ‘duty of labor’.
