비교헌법동학 : 헌법성립과 헌법변경의 비교유형론

국문 초록

이 논문에서는 비교헌법동학의 기본적인 연구 성과들을 헌법성립과 헌법변경으로 대별하여 정리한 다음, 우리의 미래 헌법제정·개정에서 참고가 될 만한 이하의 사항들을 지적했다. 헌법의 성립, 특히 공식적 헌법제정에 관해서는 첫째, 실제 제헌이 진행되는 상황은 대개 그것이 순조롭게 진행되기 어려운 여건일 가능성이 높다는 점, 둘째, 제헌기관의 구성이 비민주적이고 제헌절차가 폐쇄적이었다면 그 승인절차에서의 민주성으로써 이를 보완할 필요가 있다는 점, 셋째, 제헌절차의 공개는 국민의 알 권리를 충족시키지만 동시에 정파 간 타협을 어렵게 만들거나 허영심·자기애와 과시욕으로 심의절차를 망칠 위험도 있다 는 점, 넷째, 포괄적인 제헌기관 구성과 민주적인 제헌절차 진행은 향후 헌법의 성공에 영향을 미치는 관건적인 요소라는 점 등을 지적했다. 헌법의 변경에 관해서는 첫째, 헌법이 오래될수록 개정의 필요성이 커지지만 반면 그 개정의 가능성은 오히려 낮아진다는 점, 둘째, 오래된 헌법이 개정 없이 지속될 경우 사법해석·입법개정 등 대체수단이 작동할 수 있지만 그것이 근본적인 해결책은 못된다는 점, 셋째, 개정의 난이도가 너무 낮으면 헌법의 안정성에 악영향을 주지만 개정요건의 가중이나 개정기관의 중복은 개정의 난이도를 과도하게 높일 수 있다는 점 등을 지적했다. 이상 제 사항들을 감안하여, 소규모 헌법회의를 의와 별도로 구성한 후 여기서 헌법의 교체나 변경에 관한 사항을 결정하도록 하고 최종 성안된 헌법을 국민투표로써 승인하는 방식을 종래 의회가 주도하는모델에 대한 대안으로 제시했다.

영문 초록

The comparative constitutional dynamics, which typifies and analyzes the experiences of constitution-making and constitutional change in different nations, can give us empirical knowledge and wisdom concerning democratic constitutional design. Following the introduction, in chapter II and III, I summarized some typological and empirical studies on “constitution-making” and “constitutional change”, and in chapter IV, drew some practically useful conclusions. First, the task of constitutionmaking, in general, emerges in conditions that are likely to work against good constitution-making. Second, the process of constitution-making, at least the mode of its legitimation, should be democratic, for constitutions produced in more democratic processes will tend to be more democratic. Third, to block the influence of vanity or self-love on the constitutional debate, as well as to enhance the possibility of political compromise, a certain degree of secrecy in the constitution-making process is inevitable. Forth, the constitution-making body should be so constituted as to reflect a broad range of social groups, for it is a key element which decides the successful operation of a new constitution. Fifth, as a constitution ages, the need for change arises, however, it also becomes more difficult to change. Sixth, judicial interpretations and legislative enactments can serve as effective substitutes for formal processes of constitutional amendment, but they cannot be fundamental solutions. Seventh, overly flexible constitutional amendment processes may cause excessive constitutional mutability and insufficient constitutional stability. Eighth, successful constitutional amendment becomes more difficult in larger decision-making bodies, and the assembly model of constitutional amendment may not be suitable for the current situation of constitutional change.
