북한 경제특구법의 분석과 전망

국문 초록

북한이 2002년 9월 이 래 신의주특별행정구법，금강산관광특구법，개성공업지구법과 같은 일련의 경제특구입법을 공포하였다. 이어서 북한은 핵문제의 현안을 미국과 일본 및 한국에 대해서 공세적인 국면을 조성하고 있다. 이 글은 북한의 경제특구정책을 중국의 경제특구정책 및 홍콩특별행정구기본법 등과 비교하여 분석한다. 중국의 경제특구정책은 사회간접자본에 대한 투자와 권한위임 및 다수 투자자의 경쟁에 의한 개발방식을 기본으로 하는 반면에，북한의 경제특구정책은 사회간접자본의 개발과 기술이전에 초점을 두고 투자사업자의 독점에 의한 위험회피가 원칙이다. 북한의 신의주특별 행정 구기본법은 홍콩특별 행정 구기본법과 같이 50년 동안의 상이한 “일국양제”방식을 채택하고^ 금강산관광특구법과 개성공단지구법은 비교우위에 있는 관광 및 개발사업을 통하여 단기적인 외화유입의 창구로 활용하는데 초점을 두고있다. 특히，2002년 7월 1일 경제관리조치는 북한경제와 체제의 가시적인 변화를 예고하고 있다. 급격한 가격개혁조치는 경제의 공급측면이 원활하지 못한 상황에서 폭증하는 수요를 중족하지 못하게 되고 나아가 가수요까지 겹치는 결과로 조인플레이션에 직면하게 된다는 사실이다. 현재 북한 전역에 확산되어 있는 진성인플레이션을 극복하기 위해서는 북미간 핵문제의 해결이 없이는 외자유치도 어렵고 또한 체제안전성도 확보되기 어려운 실정이다. 따라서 북한의 장단기 목표는 미국을 비롯한 국제사회로부터 체제안정을 보장받는가 여하에 달려있다.

영문 초록

The North Korea recognized that the Chinese Government clearly recognized economic growth and development could not be accelerated while the economy is in a largely autarky state. The Chinese Special Economic Zones(*SEZs) had been considered as a window facing the world. From the outset, the Chinese leadership asked Guangdong and Fujian to turn the SEZs into bases and windows on China s reforms and opening up. The SEZs were to be windows on technology, management, knowledge, and China s foreign policy. The existence of the SEZs in the coastal areas will facilitate convergence with Hongkong when it reverted to China in 1997. In comparison with the gap between Hongkong and interior provinces in China, the success of the SEZs would also be of great significant for the future prospect and desired unification of Taipei and the Chinese mainland. In analysing China’s special economic zones, much attention had been focused on the specific preferential treatments offered to foreign investors and to the concrete ways to foreign capital. So North Korea Government also introduced to the model of Chinese SEZs* policy to the Shineuyju Special Administration Region as well as Special Economic Zones such as Kumkang Mt. and Gaysung Industrial Region in 2002. Those policies in general are the following: 1. The SEZs may rely mainly on foreign capital for the construction of their facilities. Their structure and means of ownership could be a combination of state ownership, cooperative ownership, private ownership and enterprises with foreign capital. 2. The SEZs could bring into full play the role of the market in regulating the economy. 3. The SEZs could give favourable treatments and facilitate entry • exit formalities for investors. 4. The Governments in the SEZs may enjoy less power in economic administration than those in other places. This paper has been organized as follows: Section 1 looks at background of SEZs between China and North Korea and the issues of 7 • 1 Economic management; Section 2 discusses the principle and policy process of Chinese SEZs, and the contents of Shineuyju Administration Region Basic Law; Section 3 considers the analysis of North Korean SEZs* Act such as the Kumkangsan Region Act and the Gaesung Industry Region Act; Section 4 concludes the paper.
