국문 초록

Purpose : In this study, the author make an attempt to suggest the way for adoption of blockchain technology to international trade payment process by looking for some solutions to solve the problems that using it. Research design, data, methodology : This paper draws on a lot of literature offering new trends and possibility of using blockchain technology in several sector especially international trade payment field. Results : First, the legal system of Korea and other countries should be accept new technology trend in their code. Second, the parties concerned with international trade payment process should be prepared their information processing system to handle new process under new technology such as blockchain. Third, the parties offering settlement service include bank, insurer and carrier should be adjustment their relationship and interest among themselves. Conclusions : The author emphasize the establishment of new payment process system using blockchain technology in international trade payment is not needed only the efforts of a specific parties but also all parties in private and public sector in order to carry out above suggestions successfully.

영문 초록

본 연구에서는 블록체인기술을 무역결제에 도입하려는 경우 요구되는 수용기반을 검토하고 이를 해결하기 위한 방안에 대하여 제시코자 하였다. 그 결과 국내외 법제 기반, 기술적 기반, 상관행 기반 등에서 법적 공백과 불일치, 신기술 적용 생태계 미성숙, 당사자간 권리의 무관계 미정립 등의 문제점들을 확인하였고 이에 다음과 같은 대안을 제시하고자 한다. 첫째, 한국 등 관련 국가의 법제하에 새로운 기술을 수용할 수 있도록 법률 개정이 필요하다. 둘째, 관련당사자들의 정보시스템에 새로운 기술을 수용할 수 있도록 준비하는 것이 필요하다. 셋째, 결제서비스 제공에 관련된 당사자간 기능과 역할 및 이해관계의 조정이 필요하다. 마지막으로 블록체인 등 신기술 적용의 성공은 어느 한 당사자가 아니라 민간영역 및 정부영역의 모든 당사자들의 노력이 필요하다는 점을 강조한다.
