과거사청산에서 사회적 의례의 인식

국문 초록

2014년부터 약 10여 개의 시민사회단체들은 한국전쟁 전후 민간인 피학살자 유해 발굴을 실시하였다. 이 발굴은 2010년 진실화해위원회가 종료된 이후 국가의 계속적인 진실규명 사업을 촉구하는 과정에서 시작되었고, 2017년까지 모두 세 곳의 매장추정지에서 약 40여 구의 유해를 발굴하였다. 시민사회단체의 유해 발굴은 이전 유족들이 중심이 되었던 발굴 및 국가주도 유해 발굴과는 다른 특성을 가지는데, 이 발굴은 유족들에게 희생자의 시신을 찾아주기 위한 발굴이기보다는, 한국에서 정지된 과거사청산을 계속 진행하기 위한 ‘사회적 담론’의 활성화 과정이라 할 수 있다. 특히 유해 발굴은 그 과정에서 유족들의 인식을 변화시키는 계기를 만들기도 하였다. 본디 유족들은 유해 발굴에서 가족의 시신을 찾는 것이 목표였으나, 시민사회단체에 의한 발굴에 참여하면서 점차적으로 과거사청산에서의 사회적 의례 인식을 갖게 되었다. 이때 사회적 의례라 함은 이전 시기 발생하였던 국가폭력의 과오를 후대에 다시금 재발되지 않도록 하는 일종의 ‘기념과 위령’의 과정으로서, 가족의 억울한 죽음을 좀 더 넓은 사회적 시각에서 바라본다는 의미를 가진다.

영문 초록

Since 2014, about 10 civil society organizations have conducted the exhumation of remains of civilian victims around the Korean War. This exhumation began in the process of urging the nation to continue its transitional justice program that was closed in 2010, it has unearthed some 40 remains in three areas. Exhumation of Civil society organizations are different from the exhumation of state and victims’ family. This exhumation is not an exhumation to find the body of the victim to the bereaved family, but rather an activation process of ‘social discourse’ to continue transitional justice suspended in Korea. In particular, the discovery of remains has also created an opportunity to change the perception of the bereaved. Originally, victims’ families were aimed at finding the body of the family in the discovery of remains, while participating in exhumations by civil society organizations, they gradually became aware of social rituals in the transitional justice in Korea. At this time, social rite is a sort of “commemoration and consolation” that prevents the mistake of national violence that occurred in the previous period from being recurred again in the future. This means that the unfair death of the family is viewed from a wider social perspective.
